Reasons to Release an Affidavit of Equitable Interest.

Clear Title for Future Transactions:
Recording a release removes any cloud on the property's title, facilitating smooth future sales, refinancing, or transfers.
Prevent Legal Complications: An unreleased affidavit might lead to disputes or legal actions, such as a quiet title lawsuit, to resolve any perceived claims against the property.
Maintain Accurate Public Records: Ensuring that public records reflect the current status of property interests upholds the integrity of property records and protects all parties involved.

When Should It Be Released.
Upon Completion of the Contract: Once all terms of the contract for deed or purchase agreement are fulfilled.
If the Contract is Terminated: When both parties agree to cancel the contract or if it's voided for any reason.
After Assignment: If the equitable interest has been assigned to another party, and the original affiant no longer holds any claim.

My goal was to find the Covenant, Conditions, and Restrictions for my HOA. From what I can read, these documents should be attached to our Deed (single family, patio home in New Hanover County). I am not sure if I have a copy of my Deed. I would need to check my Safe Deposit Box. Unfortunately, I was not successful at finding these documents from your Website. If you can help me find them, I would appreciate that.

It is most common to obtain a copy of CC&Rs directly from the HOA. Alternatively, they are also usually a matter of public record recorded with the local recorder and you can obtain a copy there.

I sent Deeds.com an email with a question, asking for a little guidance as to which form(s) I need, but I'm waiting for a reply. My wife and I own 3 homes (2 in Indiana & 1 in Florida). We are needing to deed each to ourselves and put them into our living trust. I asked Deeds.com to please help by suggesting which forms I need for this. I do not want to get the wrong ones. I have not received a reply yet. When I receive a helpful reply and am able to purchase the correct forms, I am fairly certain my rating will go from 1 to 5. I withhold judgement until later.

Thank you for your feedback Michael. We make available do it yourself deed documents. We do not prepare documents or provide legal advice. If you have done research and are still unsure of which documents you need we are not the website for you. We highly recommend seeking the advice of a legal professional familiar with your specific situation moving forward. Have a wonderful day.

I am a litigator based in Lee County that rarely needs to record deeds or mortgages. However, at times, the settlement or resolution of a dispute results in the conveyance of real property. I ended up in a situation where a deed to real property in Bradford County needed to be recorded on behalf of a client. My usual e-recording vendor does not include that County. Registering with Bradford County's regular e-recording vendor would have required an expensive and unnecessary annual fee. Deeds.com was easy to use, inexpensive and fast. I highly encourage its use, especially for lawyers that occasionally need to record instruments but do not do so regularly.

The Deed of trust form was fine but the promissory note was less user friendly since I needed to change a few things that were fixed in the template. I ended up using white-out after I got no response when I emailed the help site that was provided in one of your emails, so it looks a little odd but should be usable

I downloaded the forms, which was very easy, and filled them out with the help of the very helpful instructions! I was able to go down to my court house and file the forms within 24 hours of downloading! I am at peace knowing my son's will avoid a lot of headaches when I pass because my property deed will transfer to them without probate court TOD !!!!

Thank you for the prompt instructions on the download and installation. The only problem I had was trying to input data into the form once I renamed the form.and saved it. I was unable to change the size of the font and was very frustrated. In the end I finally had to redo the entire form through Word using your format.
