A trustee uses a trustee's deed to convey property held in a living trust in Missouri.
In a trust arrangement, the settlor conveys property to the trustee, who holds title to the property for the benefit of a third party, the trust's beneficiary.

The trustee is the administrator of the trust whose power to sell trust property, in this case, is conferred by the trust instrument, the document executed by the trust's settlor establishing the trust and containing the trust provisions. The Missouri Uniform Trust Code also confirms the trustee's power to "acquire or sell property in divided or undivided interests, for cash or on credit, at public or private sale" ( 456.8-816, RSMo).

The granting language of "bargain and sell, convey and confirm" is the common language used in Missouri to transfer property to a grantee with special warranty. A special warranty contains limited covenants of clear title (subject to noted encumbrances), and protection against claims arising by or through the grantor only.

In addition to meeting the requirements for content and format required by standard deeds, such as quitclaim or warranty deeds, trustee's deeds must also reference the trust instrument designating the acting trustee. The deed must be signed by the acting trustee's in the presence of a notary public for a valid transfer. A distinct acknowledgment form for trustees is codified at 486.330(5), RSMo.

I downloaded the Lady Bird deed. The process was quick and easy to download. Just select your county, fill out the form. You will need the property description from your original deed. In my case I had to go downtown Wayne County (Detroit). (Make an appt online). 1st you will have to get the property tax certified to ensure all taxes are paid to date (5th floor at the Wayne County Treasurer office). Give them the form you just filled out and they will stamp certified $5. After that take the form to the Register of Deeds (7th floor) appt needed. $18. Make sure it is properly notarized and all signatures completed. Once approved, they will scan it, stamp it, give it back with a receipt and mail a copy also. All Done. Worked beautifully. My co worker go a lawyer and paid over $250. I just used deeds.com and total for forms and going downtown with notarizing was less than $40 Yea!

Sign up process was fine. The search could be refined a bit to make it easier. Rather than being presented with a large number of fields and trying to figure out, it say street suffice (Drive, Street, Lane) are needed and with what spelled out, what abbreviated it would be nice to have them presented as questions with examples. The $30 price point of r a deed is way too high for me as an appraiser. This is why I didn't complete the transaction.

re: Transfer Upon Death Deed For Valencia County, NM, why not have ONE button to download all necessary forms? Individual buttons are tedious.

First time using Deeds.com and feel that your platform is clear and easy to use. I was also pleased with the messaging center and follow-up and also surprised at how quickly our particular deed was recorded and available to view. Having said that, when I first investigated Deeds.com the fee was $15 and as of 1/1/21 it has increased to $19 which I feel is pretty steep for the handling of 1 simple document especially when the turnaround was basically the same day. Your fee was nearly the equivalent of the cost of the Clerk's recording fee. Perhaps you should offer a fee schedule for those of us who are not volume recorders. Just a thought.

Came with all the paperwork that I needed plus a lot more paperwork than what I needed. Covered all the bases! The instructions were a big help. Easy fill in the blanks. Had no problem filing the paperwork afterword at the County Clerks office. Definitely worth the $20.
