What is the Nebraska Owner Notice of Commencement

Construction liens are governed under the Nebraska Construction Lien Act, found at Sections 52-125 to 52-159 of the Nebraska Revised Statutes.

A notice of commencement is used by a property owner to put all other parties on notice than an improvement will be made to the owner's real property. Another (more important) purpose of the notice is to start the time within which construction liens can be claimed.

A notice of commencement must be signed by the contracting owner, be identified as a notice of commencement, and state: (a) The real estate being or intended to be improved or directly benefited, with a description thereof sufficient for identification; (b) The name and address of the contracting owner, his or her interest in the real estate, and the name and address of the fee simple title holder, if other than the contracting owner; and (c) That if, after the notice of commencement is recorded, a lien is recorded as to an improvement covered by the notice of commencement, the lien has priority from the time the notice of commencement is recorded. Neb. Rev. Stat. 52-145(1).

The notice of commencement may also define its duration, with a minimum limit of six months from the time of recording. Neb. Rev. Stat. 52-145(2). If no duration is stated, the duration of the notice is one year after the recording. Id.

The notice of commencement may state that it is limited to a particular improvement project, or portion thereof, on the real estate. Neb. Rev. Stat. 52-145(3). But the limitation is not effective unless the particular improvement, or portion thereof, to which it applies is stated with sufficient specificity that a claimant, by reasonable inquiry, can determine whether his or her contract is covered by the notice of commencement. Id.

A contracting owner may extend the duration of a notice of commencement by recording, prior to the stated or implied time limit, a continuation statement signed by him or her which refers to the record location and date of recording of the notice of commencement and states the date to which the notice of commencement's duration is extended. Neb. Rev. Stat. 52-145(4).

Order Process: 5 Stars - very easy
Material Received: 2 Stars
Issues:
1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office.
2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font.
3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility.

Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability.

I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.

Not a fan. Filling in the WI RE transfer return was simple enough. However, it downloaded as a DOR file and I can't find a program to open it. So, I have no way to print the form to complete the process.
