Revoking a Nebraska Transfer on Death Deed
The Nebraska Uniform Real Property Transfer on Death Act is found at Sections 76-3401 to 76-3423 of the Nebraska Revised Statutes. This useful law provides an option for land owners to convey their real estate after their death, but without the need to include it in a will.
A transfer on death deed (TODD), when lawfully executed, allows property owners to retain absolute title to and control over their land during their lives ( 76-3414). The deeds are also revocable (76-3413). In part, these features are possible because unlike traditional deeds (warranty deeds, quitclaim deeds, etc.), TODDs do not require consideration from or notice to the beneficiary ( 76-3411).
Revocability is a valuable feature of transfer on death deeds. With it, land owners can quickly and easily respond to changes in their lives or the lives of their beneficiaries, and redirect any future transfer toward a more appropriate outcome.
The options for revoking a recorded TODD are set out at 76-3413. They include executing and recording one or more of the following: a document that specifically revokes the TODD ( 76-3413(1)(B)); a new TODD that revokes the previous deed and changes the beneficiary or details about the transfer (76-3413(1)(A)); or transferring the real estate with a traditional deed (76-3413 (1)(C)).
Because there is more than one way to revoke a TODD, an instrument of revocation can also provide an endpoint for a recorded (but cancelled) transfer on death deed. Executing and recording such a document before selling the property or simply transferring it to another beneficiary ensures that future title searches will not show the potential for claims against the title from the earlier TODD. The resulting clear chain of title (ownership history) should help to simplify future transactions involving the same real estate.

It was convenient to be able to download the deed template, instructions, and a completed sample deed all from deeds.com. I was able to complete my deed with little effort. My only complaint is that the editable fields in the pdf document are of fixed size, leaving some large spaces within a sentence, for example: Executed on this 1st day of July ,2020. This makes the printed document look a little peculiar.

I would have liked more room in the text fields for describing the potential claim. had to use Exhibit A. Could not delete Exhibit B. Alo would like to have a custom footer - not deeds.com. Unprofessional.

I downloaded the quit claim deed form and saved it on my computer. I opened it with Adobe and filled it out. The space for the legal description was too small (2 lines only) which did not allow enough room for the long property description that I had.

I tried 3 local attorneys and got no where , wrong information, to busy and another one was very rude. One said he'd do it then didn't. I was so stressed and tried a different online form company advertising an in person attorney within hours. They did call back but gave me the wrong answer. I needed a form used in NC and knew about it from the clerk of the court. The deadline was approaching, I looked one more time and found Deeds.com. They have the form and the much need instructions and for less than $30.00. I am so pleased and also relived!

Downloaded and used the Ladybird Warranty Deed for a county in Florida with no issues. Cost for the download and subsequent recording fee of the deed totaled less than $40. No reason to pay hundreds. I assume the subsequent transfer upon death will go smoothly, but I of course, will never know. The "example" of a completed form was very beneficial. Also, get a copy of the current deed and make sure legal description of real estate is exactly the same on the new deed.
