Transferring New York Real Property with an Administrator's Deed

Administrator's deeds are used to transfer title to real property when the owner died intestate (without a last will and testament).

The Surrogate's Court appoints an administrator to distribute the deceased individual's estate according to the rules set out in section 4-1.1of New York's Estates, Powers, and Trusts Law (EPT). The surrogate (the judge managing the case) issues documents called letters of administration, authorizing the administrator to begin his/her duties. If the estate includes real property, those duties could include using an administrator's deed to sell it.

Administrator's deeds contain the same information as warranty or quitclaim deeds, but they also include details about the administrator and the deceased owner. The administrator acts as the grantor on the deed, and his/her signature must be notarized. Some cases may require a witness to sign the deed in front of the notary, too. Note that at sections 309-a and 309-b, New York's Real Property Law (RPP) sets out specific notary statements based on whether the deed is signed inside or outside the state.

In addition to the standard state and local forms that accompany deeds submitted for recording, administrators might need to attach letters of administration from the Surrogate's Court, certified copies of the decedent's death certificate, and other supporting documentation as appropriate. Depending on the circumstances, the sale might also require court approval.

Laborious process to gain access; need to indicate PRIINT when complete and inform that if page is backspaced, entered info disappears, necessitating starting all over again. There is only one “A” provision, when some documents have several more. Space is too limited in some instances to provide what is necessary for recording. Thank you

I was unable to end up going through with the deed process on my own as it was out of my realm. I suspect if I knew what I was actually doing when completing a deed, it would of been sufficient. I ended up having to go through an attorney to complete the deed.

Once I had everything right;the recording was fast and easy. I was updated at every juncture and apprised of my mistakes in order to fix and record my deed. To improve service: I think that several different examples and scenarios would have helped. If you have different names from your children; birth certificates and marriage certificates are a requirement in Clark County, NV. If you want to add anyone to the deed in a Quit Claim Deed; you have to add yourself as a grantee even if you are the grantor along with the other grantees.

I have an apple phone. I could not fill in the form to pay because apple phones do not have a dash that can be used when the field requires a phone number with a dash. I had to borrow an android phone in which the telephone keypad had a dash that could be used. It was easy to pay using an android phone but impossible to pay using an apple phone. Remove the requirement for dashes to allow apple phones to use this service.

While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!
