In a Deed of Trust, the trustee is an independent third party who holds conditional title on behalf of the lender for the purpose of either reconveying the property back to the borrower after the loan is repaid or selling the property if the borrower defaults on the loan. Trustee's can be replaced for many reasons, incapacity, incompetency, death, etc. Often a lender will substitute a trustee with a firm or corporation that will be conducting a foreclosure.
NCG 45-10. States:
In addition to the rights and remedies now provided by law, the noteholders may, in their discretion, substitute a trustee whether the trustee then named in the instrument is the original or a substituted trustee or a holder or owner of any or all of the obligations secured thereby, by the execution of a written document properly recorded pursuant to Chapter 47
This form is executed by the beneficiary/lender for the substitution of a trustee, it includes an optional foreclosure clause if needed for that purpose.

This is not at all the form that I needed. I am trying to disclaim my interest in a property, but this form is much too rigid to work for my case. It would have been nice to know some of the more specific details before purchasing the document.

If I hadn't spent my career as an escrow officer (albeit in another state), I may have had a hard time figuring out exactly which deed I needed and how to prepare them, even with the back-up informational, how-to pdf documents, without an attorney. My experience speaks to how much the general public doesn't understand and how confusing it can be. Nonetheless, the access to so many documents at a fairly reasonable cost, the basic how-to docs made available along with the purchased doc makes all the difference. From Pennsylvania here. Documents are great and easy to fill out however you are lacking a couple of things. You only provide the option for a Grant Deed when you purchase by your county which is Mercer County for me. Why not give the ability to get a Warranty Deed that better protects the Grantee? Also, being from Pennsylvania and in a county that mined Buituminous Coal we are required to include the Coal Severance Notice and Bituminous Mine Subsidence and Land Conservation Act Notice. You can check the box on your Deed form that they are required and attached but you do not provide the verbiage or form for this. You state that you know what each county requires and include everything required but you do not include these two required Notices. This has been a requirement for years and the wording never changes. I had to look for these Notices and hand type this information and include it on another seperate page after the Notary section on the Deed. The Grantor has to sign the Coal Severance Notice and be witnessed by a Notary so I had to add another place for the Notary and will have to pay twice for witnessed signatures when it could have been included in your document. My Deed from 2003 was done that way and then the Notary statement after that so it was only one notarized witness of signature.

tl;dr - Bookmarked and anticipating using this site for years to come. My justification for rating 5/5 1. Provide intuitive method for requesting property records. 2. Cost for records *seems reasonable. 3. They clearly state that interested parties could gather these records at more affordable costs through the county (which was more confusing for an inexperienced person such as myself). I mean, I appreciate and respect this level of honesty. *I didn't shop around too much because it was difficult for me to find other services that could deliver CA property records.
