This form is used by a beneficiary/lender who can be a corporation or individual to assign deed of trust and promissory note to another entity/corporation or individual. This is commonly done when a deed of trust has been sold. (The assignee of the note shall have the right to enforce all obligations contained in the promissory note or other agreement, and all the rights of the assignor in the deed of trust, mortgage, or other security instrument, including the right to substitute the trustee named in any deed of trust, and to exercise any power of sale contained in the instrument without restriction.) (47-17.2)
Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Deed of Trust" forms.
The Truth and lending act requires that borrowers be notified when their Deed of Trust debt has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

I like the basics. The one thing I would recommend changing would be, something that tells me I have actually have submitted my package, or that I can leave at any time without needing to click on a "Submit" button.

Nice service at a fair price. Website is not very user oriented. Messages accumulate in the messages area but are not emailed to the client. If you used the service regularly, it would be more understandable but for a first time or occasional user, the site can be time consuming.

Excellent Site for recording documents to respective county Recorder Office. My recording was suspended But KVH (Staff) gave me proper timely advise and guided me for the procedure till recording was done by county office. The information and instructions provided is thorough and great. But, the fill-in-the-blanks form does not work well and is very frustrating. The font size of the information I was adding on each individual line varies and is determined by the number of characters entered on that individual line. So the font size is different on each line. And the number of lines is fixed making it impossible to fill in the full legal name of the trust I needed to fill out the form for. My needs are somewhat unusual, but the form should have been designed to be flexible enough to handle it. A blank paper form would have been more useful.
