The powers granted to the agent are broad and sweeping, defined in Chapter 32 of the North Carolina Power of Attorney Act, that became effective January 1, 2018.
This POA is effective immediately and is a Durable Power of Attorney, (the incapacity of the principal does not terminate the power of attorney.) A predetermined termination date can be set into this document and/or may be revoked by the principle at any time by providing written notice to the Agent. 32C-1-102 (2)
This POA includes a Substitute Agent in the case the Agent can't or won't act.
1. (The successor agent has the same authority as that granted to the original agent.
2. The successor agent may not act until all predecessor agents have resigned, died, become incapacitated, are no longer qualified to serve, or have declined to serve.) 32C-1-111 (b)
In general, a NC Power of Attorney is NOT required to be recorded unless a real property transfer or a business transaction occurs on behalf of the incapacitate principle. Although recording may not be required it is considered prudent. This form is formatted to meet N.C. recording standards.

Great to have a downloadable form, rather than a cloud solution that gives no guarantee of privacy. Appreciated the sample.......but all of that still left me with open issues about how to tweak the form to serve my particular needs......for example: how to ensure that survivor rights were properly characterized; how far back I should go with the "Source" section + how I should layer my own additions to the chain of ownership, etc. Nonetheless, an overall happy experience. I had an issue due to the fact that I had many beneficiaries. I was and still am not sure how to handle this. We do have Adobe Pro and can modify the form, if needed. But I would like to talk to your organization for more information.
While we are unable to assist you specifically with completing the document we can note that this is addressed in the guide. Information that does not fit in the available space should be included in an exhibit page.

I bought a Quitclaim Deed package for Fayette County, Kentucky, to transfer my house into a Living Trust that I had set up previously. Creating my Quitclaim Deed was pretty straightforward, using the form, the instructions, and the sample Quitclaim Deed. I signed my Quitclaim Deed at a nearby Notary Public, then took it to the Fayette County Clerk's office to be recorded. The clerk there asked me to make two small changes to the Quitclaim Deed, which she let me do in pen on the spot: * In the signature block for the receiver of the property, filled in "Capacity" as "Grantee as Trustee ______________________________ Living Trust". * In the notary's section, changed "were acknowledged before me" to "were acknowledged and sworn to before me".

Came with all the paperwork that I needed plus a lot more paperwork than what I needed. Covered all the bases! The instructions were a big help. Easy fill in the blanks. Had no problem filing the paperwork afterword at the County Clerks office. Definitely worth the $20.

I followed the instructions to download the form for my Mac, typed in the legal description of the real property but the space provided for it would not expand so I just typed the form into Word as a document. While I appreciate having the form to work with it would have been a breeze if it worked properly.
