Real property can be transferred in North Carolina by using a special warranty deed. This type of deed does not have the same warranties of title contained in a general warranty deed. The North Carolina General Statutes do not offer a statutory form for real estate deeds. The grantor in a special warranty deed offers the following covenants to the grantee: (1) that the grantor has done nothing to encumber the title, and (2) that the grantor will warrant and defend such title against the lawful claims of all persons claiming by, through, or under the grantor.

North Carolina requires strict compliance with the statutory acknowledgment provisions in order for documents to be recorded and to provide constructive notice. Before it can be accepted for recording by a register of deeds, a special warranty deed must be signed by the grantor and properly acknowledged before an officer authorized by the state of North Carolina to take acknowledgments of deeds. The individual form for an acknowledgment by a grantor in 47 38 of the North Carolina General Statutes is sufficient to use for a special warranty deed acknowledged within the state. If a special warranty deed has been executed and acknowledged in a state other than North Carolina, the deed will be valid to record in this state, but it must conform to North Carolina law.

The recording statute in North Carolina is a pure race statute, which means that the first document recorded will have priority. A conveyance of land will not be valid to pass any property interest as against a lien creditor or purchaser for valuable consideration from the donor, bargainer, or lesser until it is registered in the county where the land lies. If the land is situated in more than one county, the deed must be recorded in each such county. Unless it is stated otherwise on the special warranty deed or on a separate registered instrument executed by the party whose priority interest is adversely affected, instruments that have been registered in the office of the register of deeds will have priority based on the order of registration. If registered simultaneously, priority will be determined by the earliest document number set forth on the registered instrument or on the sequential book and page number if there is no document number ( 47 18).

I needed a quitclaim deed to transfer ownership of a home. An attorney wanted $400.00 to file the deed. I downloaded a blank deed for my area from deeds.com. I received it instantly. (Small fee) it came with instructions and a template. I filled it out and submitted it to the County Clerks office.it was simple and I saved a lot of money. There may be other forms you need, check with whoever you are submitting the deed. You'll have additional fees, but that is up to the municipality in which you reside. It will be helpful if you have the latest deed on file. It was much easier than I thought. This is an easy website to navigate through and it is 100% legitimate. I recommend Deeds.com.

The form was easy to fill out. The only problem I had was on the Notary page I live in a different state than the property and I couldn't change the name of the state or county where the notary had to sign.

It was OK but unfortunately useless. The jurisdictions are now requesting that documents such as Notices of Commencement not only be recorded at their offices, but also certified. This last service is not provided by Deeds, or at least I could not find it in your website and did not receive a response when I asked if you did. Thus, we are going back to traditional means of recording/certifying

Great service! Easy to download and view. Florida should have the Revocable Transfer on Death (TOD)deed, that many other States have. That's the one I really wanted. This one will do in the meantime.

It all started out well, then I was abruptly told that I would have to submit the documents directly to the recording office. No explanation was offered and I wasted a lot of time on your website for nothing. Very disappointing, as the concept of e-recording is what is needed in 2026.

We reviewed your order and our support messages. The document uploaded for recording was a very low-quality scan that did not meet the county’s eRecording image requirements. Our staff asked that a clearer scan be uploaded, but the same image was submitted again.

Because the document could not be processed electronically, we advised recording it directly with the county recorder’s office.

E-recording systems require clear, legible document images that meet county standards. When those requirements cannot be met, recording directly with the recorder is often the fastest option.
