What is the Oklahoma Disclaimer of Interest

Oklahoma Disclaimer of Property - Description

Under the Oklahoma statutes, the beneficiary of an interest in property may renounce the gift, either in part or in full (84 O.S. 22-30). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest.

The disclaimer must be in writing and include a description of the interest, a declaration of intent to disclaim all or a defined portion of the interest, and be signed by the disclaimant.

File the disclaimer within nine months of the transfer (e.g., the death of the creator of the interest) with the district court having jurisdiction over the estate and deliver a copy of it to the representative, trustee, or other person holding legal title of the property. In the case of real property, record the original disclaimer, or a copy certified by the clerk of the district court, in the office of the county clerk in the county (or counties) where the real estate is situated (84 O.S. 24-25).

A disclaimer is irrevocable and binding for the disclaiming party and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits of disclaiming inherited property. If the disclaimed interest arises out of jointly-owned property, seek legal advice as well.

This is a great tool to use. It makes recording documents so easy and convenient. The website is very user-friendly. The only suggestion I would have is if the website could email me directly when I have a message so I don't have to keep checking back to see if my document is ready.

Well worth the $20.00 for the Transfer on Death Deed, if you are willing to do the leg work to notarize and record the deed. Money well spent and money well saved. The value is in the short, bullet type instructions and State specific forms and requirements.

Ordered the forms I needed for my state and county and everything worked out perfectly. All the forms came with examples (filled in) and very detailed instructions for each block that required an entry. I was able to fill everything out on my computer and save the files for future use, if required. Deeds provides an excellent product. I purchased he Alabama Correction Warranty Deed Form to correct a mistake in the legal description. However, this form says it must be signed by all who previously signed the deed. One of these people is now deceased. Can I use this form? How would it be different? I would give you 5 stars but wish this issue had been addressed. Thanks.
