An executor's deed is a statutory form under RIGL 34-11-12 for sales of real property from a probated estate. An executor is a court-appointed fiduciary entrusted to administer a decedent's estate. He or she is the personal representative named in the decedent's will.
Use an executor's deed to transfer title to a purchaser with implied fiduciary covenants. Executor's deeds contain covenants that the grantor is the duly qualified and acting executor of the estate, that he or she has good right and lawful authority to convey the decedent's interest in the subject property, and that he or she, in his or her capacity, has given bond as required by law and has complied in all respects with the court's decree.
In Rhode Island, the probate court must authorize sales of realty from the estate (RIGL 33-19-3). Prior to the sale, the executor files a petition for the sale of real estate with the court, which must include the reason for the sale. Valid reasons for petitioning for the sale of real property under RIGL 33-12-6 include enabling the payment of debts or facilitating efficient administration of the estate. This authority excludes sales of real property that is specifically devised by the decedent's will, unless the devisee(s) give consent to the sale. An executor with a power of sale under a will must also obtain consent to sell specifically devised real property (RIGL 33-12-6).
In addition to meeting the standard requirements for form and content of deeds in Rhode Island, the executor's deed should reflect the true consideration paid by the grantee for the grantor's interest in the realty. Rhode Island levies a real estate conveyance tax based on purchase price, to be paid by the grantor, due upon recording (RIGL 44-25-1). Submit a conveyance tax return (CVYT-1) to the Rhode Island Division of Taxation. The executor may also be asked to furnish an affidavit of residency to the buyer, unless the deed includes a statement that no withholding of tax under RIGL 44-30-71.3 is required.
The executor must sign the deed in the presence of a notary public for a valid transfer. Recording in Rhode Island is done at the municipal level in the town or city where the property is situated. Submit the completed, signed, and notarized deed, along with any supplemental documents, to the land evidence division of the town clerk in the municipality where the subject parcel is located.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

It would be helpful if the numbers on the instruction sheet were on the form. I was confused on page two if the signatures were for witnesses or buyer (grantee). I do like the form and will use it in the future. Also page one Grantee's signature only has one line and if there are two buyers need another line.

Your documents were very helpful. I went ahead and filled in all the info for the Release of Lien document. It was easy to do with your example. I had all the necessary info such as plot numbers, etc. for the property and everything fit nicely onto the document. It has been notorized and mailed.
