This document is often recorded to protect the interests of the parties involved, particularly the buyer, by giving public notice that a contract exists concerning a specific property. The Release of Memorandum of Contract is a document used to formally end or release the claims of the Memorandum when the contract has been terminated, fulfilled, or no longer applies.

Here are the laws, codes, and statutes that guide why a Release of Memorandum of Contract should be recorded in South Carolina:

1. Notice to Third Parties
South Carolina Code § 30-7-10 (Notice of real estate interests): This statute explains that recording certain documents (such as deeds or contracts) provides notice to third parties regarding property interests. Recording a Memorandum of Contract serves as notice that a binding agreement is in place regarding a particular property.

Once the underlying contract is fulfilled or terminated, a Release of Memorandum of Contract should be recorded to notify third parties that the previously recorded interest is no longer valid. This was exactly what I needed. For $25-$30 it gave me the formatted document I needed and made it so easy to input the info. I wouldn't recommend it to someone who has no clue what they're doing, but for somebody who knows all the info and just needs a formatted page to input it onto, this is perfect.

The process was not difficult but I don't think that it suited my needs.
There were several fields that were not applicable to me but I had to enter something to proceed.
I also filled out the other form and mailed it in with some documentation that the electronic service did not ask for.
Questions of my attempt are still unanswered. I hope I didn't waste time with this process. We shall see.

This is an option for recording that worked flawlessly with my county government. Given Covid19 has closed county offices to the public as well as the personal kiosks options to record shrunk dramatically. I recommend Deeds.Com for your recording needs.
