Power Not Affected by Principal's Incapacity.
This Power of Attorney is durable as provided by S.C. Code Ann. 62-8-104 which means that it is not terminated by the principal's incapacity. "Incapacity" means inability of an individual to manage property or business affairs because the individual: (A) has an impairment in the ability to receive and evaluate information or make or communicate decisions even with the use of technological assistance; or (B) is: (i) missing; (ii) detained, including incarcerated in a penal system; or (iii) outside the United States and unable to return.
I specifically direct my Agent to defer to and abide by any Health Care Power of Attorney, Durable Power of Attorney for Health Care, "Living Will" or Declaration of a Desire for A Natural Death [hereinafter "Declaration"] executed by me. My Agent shall in no way interfere with, impede, or act contrary to my wishes, intention, and directives in such instrument or instruments. In the event any decisions or matter within the scope of the Agent's authority granted herein should directly conflict with the authority of directives of any of the aforementioned instruments executed by me, then any such instrument or instruments shall control, supersede, and take priority over any such conflicting decisions or matter within the scope of authority granted herein.
Incidentals
Pursuant to S.C. Code Ann 62-8-108, l hereby nominate my Agent as my conservator or guardian for consideration by the court if protective proceedings for the estate or person are begun after the execution of this power of attorney. My Agent shall be eligible to serve in other fiduciary capacities, for me or my benefit, including but not limited to serve as trustee and/or committee. I hereby nominate, constitute and appoint my Agent to act in any or all of the aforementioned capacities and serve without bond. The appointment of a guardian and/or conservator shall not terminate any authority granted or matters within the scope of this Durable Power of Attorney.

AMAZING! Easy to use, reasonable fee - and get MUCH MORE than just a deed form. I ordered a "deed" and received a whole "package," including a guide and the jurisdiction's costs schedule and cover page that would be needed to record the deed - even included a Certificate of Transfer that is not required for a deed but something I needed for a different transaction. The website was extremely easy to use and the cautions about not disclosing personal information were so clear and personal, they made me feel secure in knowing this site was not trying to rip me off. The Oregon TODD transfer on death deed template worked great and was easy to use. They had instructions and a guide that had good pointers to filling everything out. It took about 2 weeks to mail in my filled TODD and receive it back from the county with their stamp. Would definitely use this service for other documents

I am still working on the forms. I am having problems doing the forms as you can only save as pdf and it is difficult to change or modify the pdf. You have to purchase a pdf convertor program.
but all seems to be there to do the deed submittals.

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

Great service! I downloaded the Quit Claim Deed package and I'm so grateful I did. It contained detailed directions on how to fill out all the forms, an example of a finalized copy, and excellent customer service. Also, if you choose to use their digital service, they will digitally submit the documents into the County Recorder's Office for you.
