What is the South Dakota Disclaimer of Interest

Under the South Dakota Codified Laws, the beneficiary of an interest in property may disclaim the gift, either in part or in full (SDCL 29A-2-801). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest (29A-2-801).

The disclaimer must be in writing and be filed within nine months of the transfer (e.g., the death of the creator of the interest) with the clerk of the court in which the estate is or was pending (29A-2-801 (b)). If real property is involved, record a copy of the document in the office of the Register of Deeds of the county in which the property is located in order to avoid any ambiguity regarding the chain of title.

A disclaimer is irrevocable and binding for the disclaimant and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits. If the interest arises out of jointly-owned property, seek legal advice as well.

Fairly easy to use. I had to really search to get some info. I had to use the Exhibit feature because the description box was way too small and I ended up re-typing it. The package had good and useful links. The County Clerk looked at it and said, "I see you used an online form, and that's OK, but..." and proceeded to show me a couple of things that were left out. They recorded it with no problems.

Great service! I downloaded the Quit Claim Deed package and I'm so grateful I did. It contained detailed directions on how to fill out all the forms, an example of a finalized copy, and excellent customer service. Also, if you choose to use their digital service, they will digitally submit the documents into the County Recorder's Office for you. The documents' format contained information needed to complete the necessary paperwork for filing with Georgia. However, the fields were not large enough to put the legal description in, and there was no way to enlarge the area. These were only semi-helpful in providing what I needed per Georgia's filing requirement.
