Under the South Dakota Codified Laws, the beneficiary of an interest in property may disclaim the gift, either in part or in full (SDCL 29A-2-801). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest (29A-2-801).
The disclaimer must be in writing and be filed within nine months of the transfer (e.g., the death of the creator of the interest) with the clerk of the court in which the estate is or was pending (29A-2-801 (b)). If real property is involved, record a copy of the document in the office of the Register of Deeds of the county in which the property is located in order to avoid any ambiguity regarding the chain of title.
A disclaimer is irrevocable and binding for the disclaimant and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits. If the interest arises out of jointly-owned property, seek legal advice as well.

This was the first time I had ever had to fill out a Warranty Deed, so if it was not for your example form on how to fill one out, I would be still be here completely lost. I thought it was easy, but I wish it were faster. I uploaded my document Monday night (after 5pm) and got my invoice the next morning Tuesday paid it right away. and my document was not sent to me as recorded until Wednesday morning even though it was recorded the day earlier at 8:30am. So there was a delay of almost 24 hours letting me know that my document was recorded. So if they could speed that up so that we knew exactly when it got recorded immediately I would give it a million stars

This service is excellent. I submitted a Quickclaim Deed so my home would be in the name of a Living Trust I had just created. This was my first attempted at any of this and the staff person, KVH, who reviewed my Deed was extremely helpful and quick to respond to any questions I had and to make sure the Deed had the correct information before submittal to the county for recording. I started the process one afternoon and by the next day, the Deed was submitted to, and recorded in, my county. I will use them again whenever needed.
