Revoking a Transfer on Death Deed in South Dakota
The South Dakota Real Property Transfer on Death Act (SDCL 29A-6-401 et seq) went into effect on July 1, 2014. It offers owners of real estate in South Dakota an option for distributing their land after death by recording a transfer on death deed (TODD). They retain absolute control over and use of the land during their lives. The transferors may even modify or revoke the future transfer without penalty, and there is no need to update their wills or subject the property to probate.
This revocability is one of the most useful features about transfer on death deeds (TODDs) under the new law is (29A-6-405). It states that a TODD "is revocable even if the deed or another instrument contains a contrary provision." This is possible for two main reasons:
<ul><li>there is no obligation for consideration from or notice to any named beneficiaries (29A-6-409); and </li>
<li>until the owner's death, the beneficiaries have no actual, or present, interest in the property (29A-6-414).</li></ul>
Find the rules for revoking a previously recorded TODD at 29A-6-410. Subject to 29A-6-411, there are three primary ways to revoke or change the future transfer: Execute and record<ul>
<li>a new transfer on death deed that revokes the earlier TODD;</li>
<li>an instrument of revocation that expressly revokes the deed or part of the deed; or</li>
<li>an "standard" deed, such as a warranty or quitclaim deed that expressly revokes the transfer on death deed or part of the deed.</li></ul>
Note that, just as with the original transfer on death deed, any instrument of revocation must be recorded before the transferor's death in the public records in the office of the register of deeds in the county where the deed is recorded. See 29A-6-411 for information about joint owners.

Not only did I find claim form but a sample claim was available for assisting on how to complete your form correctly. Found this so very useful for us (public resident) to fill in the form as a .PDF file that prints out typed form - rather than handwritten entries. There is a fee but your access is always available on internet to this site in the future. Saved me time using this site and My filed form looks professional. You have access to several other forms if needed.

Review: After a little glitch due to heavy volume at the County Recorder, my document was recorded. County Recorder was closed to public access at the office (due to the coronavirus issues) so all documents were either mailed to them or sent in electronically. Deeds.com was very efficient at their end with very quick responses to my questions and concerns. I would definitely use their services again.

Review: Great product. It would be better if the document files were not embedded within other files. It made downloading a little confusing. The titles of the forms did not match exactly word for word, which required a lot of back and forth to make sure I had downloaded the proper document. What would be great is if once you download a document, the hyperlink changed color, or somehow denoted the document had been downloaded. Just a suggestion. Review: First time using Deeds.com and feel that your platform is clear and easy to use. I was also pleased with the messaging center and follow-up and also surprised at how quickly our particular deed was recorded and available to view. Having said that, when I first investigated Deeds.com the fee was $15 and as of 1/1/21 it has increased to $19 which I feel is pretty steep for the handling of 1 simple document especially when the turnaround was basically the same day. Your fee was nearly the equivalent of the cost of the Clerk's recording fee. Perhaps you should offer a fee schedule for those of us who are not volume recorders. Just a thought.
