Common reasons to release a Memorandum of Contract in Tennessee
1. The contract has been fully performed, and the deed has been delivered and recorded.
2. The contract has expired without full performance.
3. The contract has been canceled or terminated, whether by mutual agreement or default.
4. The memorandum was recorded in error or relates to an offer that has been withdrawn.

Failure to record a release may result in a “cloud on title,” hindering the seller or buyer from subsequently selling, refinancing, or insuring the property, as the memorandum constitutes a recorded claim against the property.

I purchased this form to add my boyfriend to the deed of our home. He owns his own business so he cannot be on our mortgage. The guide doesn't clearly explain adding a person rather than focusing on transferring during a purchase or selling of a home. For future, I'd recommend make a few different examples for those who are trying to use this for the other options a Quit Claim Deed is needed for.

Great Job guys! I would not even have thought to look for this service. The county recorder's office and kiosks are all closed because of covid. Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. Sorry that this a little late. I'm VERY HAPPY with everything. The deeds paperwork was just what I was looking for. It was very to fill out, it was different than n the folks used years ago.
