Common reasons to release a Memorandum of Contract in Tennessee
1. The contract has been fully performed, and the deed has been delivered and recorded.
2. The contract has expired without full performance.
3. The contract has been canceled or terminated, whether by mutual agreement or default.
4. The memorandum was recorded in error or relates to an offer that has been withdrawn.
Why release is required:
Failure to record a release may result in a “cloud on title,” hindering the seller or buyer from subsequently selling, refinancing, or insuring the property, as the memorandum constitutes a recorded claim against the property.

After a little glitch due to heavy volume at the County Recorder, my document was recorded. County Recorder was closed to public access at the office (due to the coronavirus issues) so all documents were either mailed to them or sent in electronically. Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues.
