An easement is the non-possessory right to use another person's real property for a specific purpose. Easements exist distinct from the ownership of the land and do not constitute full ownership of the property in question. Easements can be both private and public. Private easements are those in which the enjoyment or use is restricted to one or a few individuals, while public easements are those in which the right or enjoyment of use is vested in the public generally or a community. Private easements are either appurtenant or in gross. Section 23.006 of the Texas Statutes discusses access easements in relation to partitioned property. The rights contained in an easement are created by an easement deed.
Because an easement represents an interest in land, it is required to be in writing, subscribed by the grantor, and delivered (Sec. 5.021). In order to be recorded, an easement deed must be signed by the grantor and properly acknowledged, sworn to with a jurat, or proved according to law (Sec. 12.001a). Original signatures are required. An easement deed may be refused for recording unless it has been signed and acknowledged or sworn to by the grantor in the presence of two or more credible witnesses or acknowledged and sworn to before and certified by an officer authorized to take acknowledgments or oaths (Sec. 12.001b). If the deed is acknowledged before a notary public in another state, it will be invalid for recordation in Texas if it does not have an official seal attached only if the jurisdiction in which the acknowledgment was taken requires the notary public to attach an official seal (Sec. 12.001d).
An unrecorded easement deed will be binding on the parties to the instrument, the party's heirs, and on a subsequent purchaser who does not pay a valuable consideration or who has notice of the instrument (Sec. 13.001c). An easement deed in this state will be void as to a creditor or subsequent purchaser for valuable consideration without notice unless the deed has been acknowledged, sworn to or proved, and filed for record (Sec. 13.001). An easement deed that is recorded in the county where the property subject to the deed is located will serve as constructive notice to all persons of the instrument and will also be open to public inspection (Sec. 13.002).

I was counting on deeds.com to help me with a closing I was working on. I stumbled with the instructions but when I recovered there were no problems. The instructions were helpful and the deeds etc. were just what I needed. I give deeds five stars. I am 76 years old and when the application asks for the user's name I always think they want my name. WRONG. I am trying to learn computer speak.

The form itself was very good and easy to use. The only problem I had was the Sample they provided. Using a different name in every spot doesnt help determine what goes where. Using "Theodore Rockafeller" as Lien Claimant in one spot and Jebediah Finklestein in another then Harvey Johnson in the last spot is confusing if you really need a helpful sample.

The process for receiving the quitclaim document worked well. I couldn't use the document. If I had been able to view the document before I had to pay for it, I would have known, but that isn't how your process works. However, that's the only snag I found. Otherwise the process for paying and downloading the document worked well. Thank you.

I had worked for a couple of months sending things back and forth to the county and still had no success. I decided to use deeds.com and it was all done in a few hours. Such a relief! While I find this to be wrong and the county should work with property owners as well as they work with third parties, I was still grateful for this service.

Although I am sure that the Quit Claim form was acceptable for my county, I felt that it was not formatted in the manor that I have seen while viewing the other deeds recorded. So that forms that I received were not useful to me.

I didn't care for it because I was having to do other things in between filling it out and all of a sudden it would not allow me back in it to make changes. Luckily I had saved it and then had to do FILL/SIGN option which looks ugly but that was the only way I could add what I needed.

Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!
