A Lady Bird deed, also called an enhanced life estate deed or reservation of a life estate with a general power of appointment, is a useful estate planning tool. When executed, the grantor conveys a life estate in real property to himself, with the remainder conveyed to the beneficiary of his choice, thereby avoiding the probate process. This type of deed enables the grantor to preserve homestead status (if claimed) as well as any deductions, protections, and tax exemptions associated with the real estate during his lifetime. In addition, he retains absolute control over the property, allowing for the option to change the beneficiary or even sell, convey, or mortgage the property before the transfer of ownership goes into effect upon the grantor's death.

I filed it and it was accepted with zero reservations by my clerk and recorder's office. The expected result (which was to remove a name from the current deed) happened almost immediately. The process for obtaining document itself was easy, and the included guide and example are great! I do have an issue with the format itself, though. The form has pre-defined text boxes, which cannot be altered without partially rebuilding the entire document. For the 'property description' field on the Mineral Deed form, the text box is not large enough for the rather lengthy legal description entered on my original plat. Fortunately, I have a copy of Adobe Pro, so I have been able to re-build the doc to accommodate this short-coming.

Making direct alterations to the document can result in them becoming non-conforming, which is why we advise customers to use an exhibit page when their legal description is extensive or does not fit.
