A beneficiary of an interest in property (real estate) in Virginia can renounce all or part of a bequeathed interest in, or power over, that property under Va. Code 64.2-2603(a), as long as it has not been accepted through actions that indicate ownership or transferred in any way (Va. Code 64.2-2611(b)). The written disclaimer must identify the creator of the interest, provide a description of the disclaimed interest, a declaration of the disclaimer and its extent, and it needs to be signed by the disclaiming party (Va. Code 64.2-2603(d)).
Deliver the disclaimer within nine months of the transfer (e.g., the death of the creator of the interest) to the personal representative of the decedent's estate or the court having jurisdiction to appoint such a person (Va. Code 64.2-2610(c)); other scenarios are outlined in the remaining sections of Va. Code 64.2-2610. In the case of real property, record the disclaimer with the clerk of the circuit court in the city or county where the property is located (Va. Code 64.2-26).
A disclaimer is irrevocable and binding for the disclaiming party and those claiming under him or her (Va. Code 64.2-2603(f)), so be sure to consult an attorney when in doubt about the drawbacks and benefits of disclaiming inherited property or if the disclaimed interest arises out of jointly-owned property.

It all started out well, then I was abruptly told that I would have to submit the documents directly to the recording office. No explanation was offered and I wasted a lot of time on your website for nothing. Very disappointing, as the concept of e-recording is what is needed in 2026.
We reviewed your order and our support messages. The document uploaded for recording was a very low-quality scan that did not meet the county’s eRecording image requirements. Our staff asked that a clearer scan be uploaded, but the same image was submitted again.
Because the document could not be processed electronically, we advised recording it directly with the county recorder’s office.
E-recording systems require clear, legible document images that meet county standards. When those requirements cannot be met, recording directly with the recorder is often the fastest option.

Well, we are 10 days from leaving the country for months and needed to notarize and record deed changes to our rental properties. We worried about USPS, UPS, DHL, etc. and hardcopies in the County's bureaucrats' hands. $40 is an excessively expensive price for this very simple form, especially since I couldn't view it before purchasing. I did successfully register the TODD at my county clerks office, although I wasn't certain it would be accepted given the notary format was on a separate page. Knowing what I know now, I would have formatted a form on my computer and filled it in with a pen. The background materials were superfluous and in my case, didn't add value.

It provides a prepared form and supporting information rather than requiring you to research and draft a document from scratch.
