Questions answered? Let's get started!

A "Memorandum of Purchase Agreement" commonly referred to as a "Memorandum of Agreement" (MOA), "Memorandum of Contract" (MOC) or "Memorandum of Understanding" (MOU) in the context of real estate, is used primarily as a means to provide public notice of an equitable interest in a real estate transaction without disclosing the full details of the purchase agreement. This document is particularly useful in transactions where the buyer and seller have agreed to terms but the final closing and transfer of the deed have not yet occurred. By recording this memorandum with the county recorder's office, the buyer establishes a public record of their interest in the property, which can protect against subsequent claims or liens by third parties.
Key Purposes of a Memorandum of Purchase Agreement:

1. Protection During the Closing Process: Real estate transactions can involve a lengthy closing process, including financing approval, inspections, and other contingencies. Recording a memorandum helps safeguard the buyer's interest in the property during this period.

2. Confidentiality: In West Virginia, a Memorandum of Land Contract commonly includes a Declaration of Consideration or Value clause because recording the memorandum triggers transfer-tax and assessor reporting obligations, even though legal title does not pass.

Impact on Title: While the memorandum itself does not transfer title, it does create a public record of the buyer’s interest, which can be important in the event of disputes or if the seller attempts to convey the property to another party.

Use with Other Real Estate Transactions: Although commonly associated with purchase agreements, memoranda can also be used with other types of real estate transactions that convey an interest in property, such as land contracts or options to purchase.

Important: Your property must be located in Jackson County to use these forms. Documents should be recorded at the office below.

This Memorandum of Land Contract meets all recording requirements specific to Jackson County.

First time user and I was pleasantly surprised how quick and easy it was to get my Deed recorded. And the fee was not outrageous.

I am a real estate attorney in CA. These Wyoming model deeds look too basic and barely adequate: no usual name and address at the top for tax statements and who recorded it. Some old fashioned legalese that only obfuscates. I won't use them. Your background info was good though.

This would be a great form but I couldn’t tell what size the font was. Also, I didn’t know how to save it so I will have to type it all over again. I’m sure I did it incorrectly.

These guys saved the day! Very good at what they do and deliver AS ADVERTISED!! My county's recorder's office was closed to the public due to the COVID-19 pandemic, and the recorder's office did not offer the service I needed online. Attempting to close on a home the following day, I was in immediate need of a deed for property that I previously owned to provide to the underwriters for my pending loan. I thought I was dead in the water and would miss my next day closing date. Strolling the internet for options, I came upon DEEDS.COM. After reading the posted reviews, I thought I would give them a try. Within 10 minutes of placing my order, I received ALL the information I requested about the property I previously owned. Thank you DEEDS.COM for the prompt, courteous, and professional service. You guys are ROCK STARS!!! I closed on my new home.

Had used website while working as Land Rep for major oil company (retired 2.5 years ago). Recently had need to do some online research and went back to Deeds.com to find needed documents. Same as before, website provides a great service at a great price.
