Under the Code of Wisconsin, the beneficiary of an interest in property may renounce the gift, either in part or in full (Wis. Stat. 854.13 (2) (d)). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest.
The disclaimer must be in writing and include a description of the interest, a declaration of intent to disclaim all or a defined portion of the interest, and be signed by the disclaimant (Wis. Stat. 854.13 (3)).
Deliver the disclaimer within nine months of the transfer (e.g., the death of the creator of the interest) to the personal representative or the special administrator of the deceased transferor and file a copy with the probate court that has jurisdiction (Wis. Stat. 854.13 (5) (c)). In the case of real property, a copy of the disclaimer may also be recorded in the office of the register of deeds of the county in which the property is located (Wis. Stat. 854.13 (5) (e)).
A disclaimer is irrevocable and binding for the disclaiming party and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits of disclaiming inherited property. If the disclaimed interest arises out of jointly-owned property, seek legal advice as well.

The template isn't that easy to work with, with you have to type out large amounts of text. Also copy and paste doesn't seem to work. Furthermore, the code listed on the guide is out of date. However, the DQC is decent in that it has all the required fields you need.

They even give you more related forms than you ask for and it turned out we needed some if those forms as well. The forms meet what our county requires for margins in records and so on. I used the "personal representative's deed." There were a few errors, after I went to record it at the county recorder's office. For #7, it should've stated "The estate of Joe Schmoe, hereby grants Mr. Personal Representative....." instead of, "I Mr. Personal Representative, as personal representative, hereby grant to personal representative...." The person at the recorder's office said you cannot state "you are granting property to yourself." Just fix that, and everything else is fine.

Order Process: 5 Stars - very easy Material Received: 2 Stars Issues: 1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office. 2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font. 3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility. Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability. regards, Jim S
