On most deeds the homestead release is signed by someone giving something up. Here it is signed by the person taking title. The Wyoming Quitclaim Deed (Interspousal) is a fillable form for a conveyance running from one spouse to the other: the conveying spouse quitclaims whatever interest that spouse holds, the operative clause prints the homestead release and waiver wording, and the receiving spouse signs the second block to release homestead rights and consent to the transfer, taking title without conveying anything back.

Why a Wyoming deed between spouses carries two signatures

Wyoming Statutes 34-2-121 lets an owner sell, mortgage, or otherwise dispose of a homestead on one condition set out in two parts: the instrument contains in substance the words releasing and waiving all rights under and by virtue of the homestead exemption laws of this state, and it is freely and voluntarily signed and acknowledged by the owner and the spouse of the owner. The caption states the price of missing either part, which is that the conveyance is void. The statute then excepts one transaction, and the text carried in current compilations excepts a conveyance of property directly from husband to wife, phrased in a single direction. No reported Wyoming Supreme Court decision construing that direction was located, so this deed declines the argument: it prints the release words and takes a signature and an acknowledgment from each spouse, answering the statutory formula whichever spouse conveys. Where the couple holds by the entirety under Wyoming Statutes 34-1-140, the same two signatures also put both spouses on the instrument, the consent point Lewis v. Wolfe, 2026 WY 63, draws from Peters v. Dona.

What the operative words reach

The statutory quitclaim wording of Wyoming Statutes 34-2-104 turns on two verbs, conveys and quitclaims, and Wyoming Statutes 34-2-105 sets the measure: every legal and equitable right the grantor holds when the deed is delivered, and nothing acquired later unless the deed adds words extending it. Nothing is promised about that interest, and Wyoming Statutes 34-1-135 implies no covenant into an ordinary conveyance, so a mortgage stays on the land and on the note and a recorded easement or severed mineral estate is unaffected. Title moves between spouses for reasons that have little to do with warranties: a residence one spouse acquired before the marriage, an inherited parcel, or a property settlement, patterns searched as an interspousal transfer deed or a spouse to spouse quit claim deed.

One conveying spouse, one receiving spouse, two certificates

The numbered sections recite the pair by role. Section 1 takes the conveying spouse and Section 2 takes the receiving spouse with the mailing address Wyoming Statutes 34-1-119(a) makes a condition of recording. The operative section then performs the conveyance in the statutory words, prints the release, recites that the parties are married to each other and that the conveyance runs directly between them, and states that the receiving spouse's signature moves no interest back to the grantor. Sections 9 and 10 carry the two signature blocks with the printed name lines Sweetwater County and Fremont County publish, and a certificate in the short form of Wyoming Statutes 32-3-115 follows each signature, so the spouses may acknowledge before different officers on different days, as the completed example shows. The form names one grantee and vests sole ownership in that spouse, so it is not set up as a deed to two grantees, an entity conveyance, or a designation that operates at death.

Filing it in the county where the land lies

Recording happens with the county clerk, priced by a statewide schedule in Wyoming Statutes 18-3-402(a)(xvi) rather than county by county, with surcharges once a document passes five different surnames or ten described tracts. No Wyoming deed tax or documentary stamp attaches. The counter document is the confidential Statement of Consideration on the Wyoming State Board of Equalization form, which Wyoming Statutes 34-1-142(b) makes a condition of acceptance; subsection (c) reaches this transaction squarely, listing nominal transfers between husband and wife among the categories where price and terms may be left off, and Wyoming Statutes 34-1-144 makes falsifying that information a misdemeanor.

I am a lawyer and purchased a specialized type of deed for a special scenario. The product received was functional, but not great. Wording is slightly clunky and the form layout was not convenient for making a professional final product. The wording also didn't contemplate a remote-state probate, which is a common scenario. Something about the PDF prevented me from doing cut and paste, so I had to do OCR to get the relevant text for inserting in my existing draft deed. Finally, while the site claims it is customized for the exact state and county, it does not appear to be well-customized for that purpose and I had to use other language (not sourced from the deeds.com document) to meet local norms.
