Fee schedule effective July 1, 2014.

StatewideTown plats are recorded at $32 per page. The fee may not exceed $125 for recording single family mortgages on principal residences where the principal debt or obligation secured by the mortgage is $75,000 or less (K.S.A. 28-115(j)). Fees are due and payable before the register of deeds is required to do the work, except for federal tax liens and releases (K.S.A. 28-115(g)). The recording fees shown include two fees charged on every page: the $3 technology fee (K.S.A. 28-115(b)) and the $1 heritage trust fee (K.S.A. 28-115(i)). The statutory fee alone is $17 for the first page and $13 for each additional page; a mortgage release or assignment is $16.

Federal tax lien notices and federal tax lien releases are $32.00 each; a copy of a federal tax lien is $1.00 per page (K.S.A. 79-2616(d)). The Mortgage Recording Fee Cap Affidavit counts as a page when calculating fees. All fees are based on the date the documents are received in the office, not the date they are executed.

Transfer tax

No transfer tax. None is collected when a document is recorded. (statewide)

StatewideThe mortgage registration tax (formerly K.S.A. 79-3101 et seq.), once levied at 0.26 percent of the principal debt or obligation secured by mortgages, was phased out from 2015 and repealed altogether beginning in calendar year 2019.

StatewideIf sufficient space is not provided for the necessary recording information and certification, that information is placed on an added sheet counted as a page. A document not of sufficient legibility to produce a clear and legible reproduction must be accompanied by an exact copy, recorded contemporaneously and counted as additional pages, and the register of deeds may reject an illegible document (K.S.A. 28-115(e)).

Submit an original or certified copy; photocopies are not accepted. Include a complete legal description, not the abbreviated legal description from the county web site or tax statements. If the 3" top margin is not left blank, a cover sheet will be added.
