The Clerk and Recorder is responsible for recording and maintaining real property records in Yellowstone County.

Recording Fees

To record a standard document, the fee is $8 per page.

For non-standard documents, add a $10 document fee.

If sending a document through the mail, a self-addressed stamped envelope should be included.

Document Formatting Requirements

* Use legible printing or typing in blue or black ink on white paper that is either 8.5 x 11 inches or 8.5 x 14 inches. All signatures, initials, dates, or other handwriting should be in blue or black ink. A whole document written in cursive is considered non-standard.

* Provide the names of the parties to the conveyance on the first or second page of any document with more than one page.

* Except for page numbers, initials, or other designations, margins should be clear of all markings. If an insignificant portion of a signature (such as the tail end of a signature) extends into a margin, the document will still be considered standard. If a significant portion of a signature (a designation such as Jr., Sr., POA, etc.) extends into a margin, this will cause the document to be non-standard.

* On the first page, provide a 3-inch top margin. At the top and bottom of subsequent pages, margins should be at least 1 inch. Side margins should be at least an inch.

* An acknowledgement by a notary is exempt from the color and margin requirements. Page numbers, the name and mailing address of the person to whom the document is to be returned, and other administrative information or designations may appear in the margins.

* In the upper left-hand corner of the first page in the 3-inch top margin and within the inch side margins, provide the name and address of the person to whom the document is to be returned. In this same section, any relevant transactional information may be legibly printed or typed. The document will be considered non-standard if the return name and address does not appear in this section. The right half of the 3-inch top margin should be left blank.

* Documents that are acknowledged as having been executed prior to April 28, 2007 must be accepted for recording and considered standard documents regardless of whether they conform to the standards.

* Include a legal description of the real property being conveyed. A street address or deed reference are not descriptions of the property. The full metes and bounds description or subdivision with lot or certificate of survey number must be included. A substitution of trustee instrument does not need a legal description, just a reference to a previously recorded document.

* The grantor must sign the document and must have his/her signature acknowledged.

REALTY TRANSFER CERTIFICATE

Any party transferring real property regardless of whether the transfer is or is not evidenced by deed or instrument or any party presenting an instrument or deed evidencing a transfer of real estate for recordation is required to file a Realty Transfer Certificate. Real estate includes land, growing timber, buildings, structures, fixtures, fences, and improvements affixed to land.

Any gain on this transfer is Montana source income and should be reported to the Department of Revenue on the appropriate income tax return.

The completed Realty Transfer Certificate must be filed with the County Clerk and Recorder when the instrument or deed evidencing a transfer of real estate is presented for recording. The Realty Transfer Certificate can be obtained from the Yellowstone County Clerk and Recorder's website.
