The assessor also serves as register of deeds and is responsible for recording and maintaining records related to real property situated in Lancaster County.

The documentary stamp tax rate is $2.25 per each $1,000 of value.

Note that recording fees are subject to change and should be verified with the local recorder prior to submitting documents.

Document Requirements

* Only original documents will be filed. Paper should be at least 8.5 x 11 inches and not larger than 8.5 x 14 inches.

* Signatures and notary seals must be included in a real property document. All parties to the transaction must sign the document. Signatures should be in dark black or dark blue ink and of sufficient color and clarity to ensure that the signature is readable when reproduced. Corresponding names should be typed or printed beneath signatures.

* Text should be typed, printed, or computer generated in black ink with a font size of at least 10 point. Use white paper of at least 20# weight without any visible watermarks or inclusions.

* At the top of the first page, an 8.5 x 3 inch space should be left blank for recording information. If this requirement is not met, a cover page will be added for $5.

* All other margins should be at least 1 inch. Non-essential information such as page numbers or customer notations may be placed within the margins except for top margins.

* Below the 3-inch top margin, a return address and document title should be given.

* If a document refers to another document, the book and page number to which it refers must be included on the document.

* Include the grantee's name and address in any deed.

* A legal description must be included with a document of conveyance. The description must include lot and block or section-township and range.

* The Parcel Identification Number is a unique number assigned to every parcel in the county. This is a 13-digit number which comprises the precinct number, section number, quart section/block number, the parcel number, and sub-parcel number.

* Every grantee who records a deed to real estate and every purchaser of real estate who has a memorandum of contract or land contract recorded shall file a completed statement with the Register of Deeds as prescribed by the Tax Commissioner. This statement may require the recitation of any information contained in the deed, the total consideration paid, the amount of the total consideration attributable to factors other than the purchase of real estate itself, and other factors which may influence the transaction. This statement is to be signed by the grantee (or the grantee's authorized agent) and will be forwarded to the county assessor. If the grantee does not provide this statement, the document will not be recorded

The Register of Deeds will not accept a deed for recording unless items 1-25 on the Real Estate Transfer Statement (Form 521) have been completed. The form must also be signed. Any grantee or grantee's authorized representative who wishes to record a deed to real property must file the Real Estate Transfer Statement. A land contract or memorandum of land contract requires a completed form 521, which is not subject to the documentary stamp tax until the deed is presented for recording.
