StatewideIf a document being filed or recorded contains more than ten entries to the county recording index, the county clerk collects an additional fee of $25.00 for each additional block of ten or fewer entries to the county recording index from the document (NMSA 1978, § 14-8-15(C)). Of each $25.00 fee, $18.00 is deposited in the county general fund and $7.00 in the county clerk recording and filing fund (§ 14-8-15(E)).

Transfer tax

No transfer tax. None is collected when a document is recorded. (statewide)

Documents must be original, signed by all pertinent parties and notarized, with complete notary information. A complete legal description is required for transfer of property; street addresses are not accepted without a legal description. Documents should be properly titled, such as “Warranty Deed” or “Lien”. Death certificates are not accepted for recording; an Affidavit of Fact as to Death may be recorded instead.

  • Residential Property Transfer Declaration Affidavit Statewide County Assessor (form approved by the Taxation and Revenue Department)
    Presenting for recording a deed, real estate contract or memorandum of real estate contract transferring an interest in real property classified as residential property for property taxation purposes; filed with the county assessor within thirty days of the date of filing with the county clerk
