What is the California Certificate of Trust?

California Certification of Trust

In California, the certification of trust is governed by Probate Code Section 18100.5.
A certificate of trust is used by an acting trustee or trustees of a trust to prove to financial institutions or other third parties that he/she/they has/have the authority to act on behalf of the trust. The certificate is used in lieu of the full trust document to keep nonessential information about the trust, such as the identities of trust beneficiaries, confidential.

The certificate verifies the existence of the trust and presents the pertinent details of the trust, such as the settlor, the trustee, the powers granted to the trustee, and, in the case that there are co-trustees, the number and identity of persons required to sign legal documents dealing with the trust. The certificate also specifies how the trust will vest title to real property.

Like all documents affecting real estate, the certification requires a legal description of the real property subject to the trust. In California, the certification also must include the trust's taxpayer ID, a number that is either the SSN of the settlor (in the case of revocable trusts) or an EIN assigned by the IRS (in the case of irrevocable trusts).
Trust law can quickly become complicated, and each case is unique, so contact a lawyer with any questions that arise.

Review: Your website advertising was somewhat deceptive regarding doing a quitclaim on a name change. "If you are transferring the property to yourself under your new name, all you have to do is update the deed from your former name to your current one." This made this sound easy. But when I downloaded the material for my state, expecting to find an example, there was no example of how to do a name change quitclaim deed! I therefore had to figure this out myself. You might have provided a warning about certain uses that were not covered in the material so that people know ahead of time that the use they needed to know about wasn't covered in the material.

Review: I took a chance and downloaded the Beneficiary Deed form -- would have liked to have been able to see the form before I paid, but I took a chance as everywhere else I looked online wanted me to fill out form online and then pay $30+ for each deed. I'm doing several, so I was glad to be able to just download the blank form that appears to be one I can directly type into on my computer. Yay! Would use your site again if needed. Thanks!

Review: I downloaded the Lady Bird deed. The process was quick and easy to download. Just select your county, fill out the form. You will need the property description from your original deed. In my case I had to go downtown Wayne County (Detroit). (Make an appt online). 1st you will have to get the property tax certified to ensure all taxes are paid to date (5th floor at the Wayne County Treasurer office). Give them the form you just filled out and they will stamp certified $5. After that take the form to the Register of Deeds (7th floor) appt needed. $18. Make sure it is properly notarized and all signatures completed. Once approved, they will scan it, stamp it, give it back with a receipt and mail a copy also. All Done. Worked beautifully. My co worker go a lawyer and paid over $250. I just used deeds.com and total for forms and going downtown with notarizing was less than $40 Yea!

Review: The QuitClaim deed does not provide enough space in the Grantor block at the top of the first page. In fact, all blocks should provide more space.
