Who Can Sign a Memorandum?
According to § 38-10-108:
The memorandum must be signed by the party against whom the enforcement of the contract is being sought (usually the person who is being asked to fulfill the contract, typically the Vendee/Buyer).
Alternatively, the memorandum can also be signed by an authorized agent of the party, meaning someone legally designated to act on behalf of the person (such as an attorney or a legal representative).

A signed memorandum helps by:
1. Making the Agreement Enforceable: If the contract falls under the statute of frauds (which applies to certain types of contracts, like those for the sale of land or contracts that cannot be performed within one year), the memorandum provides the written evidence required to enforce the agreement.
2. Preventing Fraud and Disputes: By requiring a signed writing, the statute of frauds and the memorandum provision protect against false claims of agreements that were never made. The signed document becomes legal proof that both parties were in agreement.

I was hoping to find information of a property belonging to my grandparents. Your site says it can go back 10-20 years I will just have to go to the courthouse and research. But very good site if your looking for recent information.

Quite simple and easy. Only one critique: It would be easier if the names of the PDF would reflect the name of the deed/form such as 'Controlling tax return' rather than '1579101185SF56863.pdf'. However I love downloading forms rather than mail.

The forms are extremely helpful. They could use some updating. Promissory note "...in the form of cash, check or money order." is a bit outdated. My note is with my son and we have an automatic bank transfer set up for payments. He could Venmo me. There are many other options and likely to be more changes in the future, so I know this is difficult to maintain.

Great Job guys! I would not even have thought to look for this service. The county recorder's office and kiosks are all closed because of covid. This was a seamless process. It probably took one minute to fill out my information and upload the document. It was formatted and sent immediately. It was processed the next day at the county recorders office. I have zero complaints. Before finding this company I spent an entire day calling and leaving messages at other e-filing companies like simplfile and others but they all required subscriptions. I just needed to file a single document now and then so that was not a good fit. (And those companies I found out still require the customer to do all the work!). I liked having the forms. Some may need to know they can look at the legal Description from online county records, then type up in Word document line by line, the degree sign in Word program is achieved by using alt and 248 on number pad. Then on the form page one write SEE Exibit A and title your Word program description as Exibit A. Goes without saying the legal description should be looked over many times and it is easier to do so if you format your Word the same lineage as the legal description online which is usually not text which is why you have to retype it.
