Certifying Payment for Labor and Materials in Kent County, Delaware

Under 25 DEL. LAWS, C. 27, 2707, prior to or simultaneous with the receipt of any full or final payment by the contractor, the contractor must provide the owner with one of two documents:
1) A notarized, verified written certification that the contractor has paid in full for all labor performed and materials furnished to date; or
2) A written release of mechanics' liens signed by all persons who would otherwise be entitled, containing a notarized, verified certification signed by the contractor that all of the persons signing the release constitute all of the persons who would be entitled otherwise to file mechanics' liens claims.

Providing a statement certifying the other potential claimants are paid lets the owner know that they are not at risk for a lien against their property. The certification identifies the parties, the location of the work or improvement, relevant dates, and a confirmation of payment. The contractor might also add a list of subcontractors and suppliers, along with payment dates and amounts, as well as any other information necessary for the specific situation.

Deliver the completed document to the owner either in person or via USPS certified or registered mail with delivery confirmation. The certificate may also be filed with the local recording office if appropriate for the circumstances.

Note that failure of the contractor to provide the owner a written certification or a release of mechanics' liens at such time shall constitute sufficient cause for the immediate suspension, revocation or cancellation of the contractor's occupational and business licenses. Id.

Deeds.com recorded documents for me without any issue. It's a good service and provides a lot of assistance on its web site. However, I asked for a printed receipt (i.e. an pdf copy of one), but after a staff provided me with an obvious answer, they simply ignored my follow up requests. I also asked a simple formatting question that they should have been able to answer; instead, they passed the buck and referred me to the recorder, which currently is a very time-consuming venture. They also have no telephone number for any issue. Generally, the service saves me the time and effort of physically recording a document, but when you think about $19.00 per recording seems like a steep price for the services rendered.

Lee County, FL did accept the "Satisfaction of Mortgage" form. It was easy to fill out except for a couple of areas. Your fill in areas need to accommodate for whatever space needed for the pertinent information we as customers have to fill out. As individuals, banks have their own. Example when there are more than 1 party and information needed. Example of Document #; I was 1 number short (using Exhibit A was ridiculous.) So I had to write in the # after printing. Very unprofessional looking on a legal document. Just saying. Also, in Lee County, FL your document # is called "Instrument #, not said in your instructions. Hope this information helps for updates on your forms.

Really solid system for determining what may prevent your documents from being accepted. I love the comments section allowing for fluid communication. I only wish there were automated emails for all those communications and once documents were accepted, but I did receive a couple personally-generated emails regarding the progress instructing me to check the site.
