This form may be used by the current mortgage holder or representative to release a mortgage that is paid in full.
To avoid penalty the (mortgagee)/lender, (his or her executor or administrator, heirs and assigns), generally has (30 days) to file the release (after the payment of the debt secured by such mortgage) (765 ILCS 905/4)

Sec. 3. An instrument in writing which releases a mortgage or trust deed of real property may be acknowledged or proved in the same manner as deeds for the conveyance of land.

If the release is delivered to the mortgagor or grantor, it must have imprinted on its face in bold letters at least 1/4 inch in height the following: "FOR THE PROTECTION OF THE OWNER, THIS RELEASE SHALL BE FILED WITH THE RECORDER OR THE REGISTRAR OF TITLES IN WHOSE OFFICE THE MORTGAGE OR DEED OF TRUST WAS FILED".

Great service! I downloaded the Quit Claim Deed package and I'm so grateful I did. It contained detailed directions on how to fill out all the forms, an example of a finalized copy, and excellent customer service. Also, if you choose to use their digital service, they will digitally submit the documents into the County Recorder's Office for you. Form needs to be gender neutral. Also, while the format prompts for the correct information to be included, more of the form needs to be open for editing and to eliminate unnecessary spacing.

I am so glad I found this resource! As the Executor of a family members estate I wanted to save money by bypassing a lawyer as it seemed pretty straight forward to tranfer a Life Estate to the remainderman. (I had original deeds). But talking with 3 different states and 4 different counties - none of which seemed to need the same documents, I was almost ready to dump this in a lawyer's lap. This resource makes it simple!
