This form may be used by the current mortgage holder or representative to release a mortgage that is paid in full.

To avoid penalty the (mortgagee)/lender, (his or her executor or administrator, heirs and assigns), generally has (30 days) to file the release (after the payment of the debt secured by such mortgage) (765 ILCS 905/4)

Sec. 3. An instrument in writing which releases a mortgage or trust deed of real property may be acknowledged or proved in the same manner as deeds for the conveyance of land.

If the release is delivered to the mortgagor or grantor, it must have imprinted on its face in bold letters at least 1/4 inch in height the following: "FOR THE PROTECTION OF THE OWNER, THIS RELEASE SHALL BE FILED WITH THE RECORDER OR THE REGISTRAR OF TITLES IN WHOSE OFFICE THE MORTGAGE OR DEED OF TRUST WAS FILED".

Why is Dade County not listed for the Lady Bird Deed?

Because on November 13, 1997, voters changed the name of the county from Dade to Miami-Dade.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. The service was great but after I did all my work and uploaded the documents they canceled my stuff because the county they had on the list doesnt take/or have set up e-recording yet. It was a bit disappointing because thats the only reason I was on here is because it brought me here from that countys sight.

Thank you for your service. It seems to have worked, I printed a document purporting to be the Deed I needed. I was somewhat disappointed though - I was expecting something as impressive as the Title Search, which goes back to 1828 and includes Millard Fillmore, admittedly not one of our most celebrated Presidents. This service is excellent. I submitted a Quickclaim Deed so my home would be in the name of a Living Trust I had just created. This was my first attempted at any of this and the staff person, KVH, who reviewed my Deed was extremely helpful and quick to respond to any questions I had and to make sure the Deed had the correct information before submittal to the county for recording. I started the process one afternoon and by the next day, the Deed was submitted to, and recorded in, my county. I will use them again whenever needed.
