An easement is the right to use another person's real property for a specific purpose. There are four ways to create an easement in Iowa: by an express grant or reservation, by prescription, by necessity, and by implication. Solar easements may also be granted in Iowa. To obtain such an easement, an owner of real property may apply to the solar access regulatory board for an order granting a solar access easement. The application must be filed according to 564A.4 of the Iowa Code.

When any person is in the use of a way, privilege, or other easement in the land of another, the owner of the land in such case may give notice in writing to the person claiming or using the way, privilege, or easement of the owner's intention to dispute any right arising from such claim or use (564.4). The notice to prevent acquisition, when served and recorded as provided, will be an interpretation of such use, and prevent the acquiring of any right thereto by the continuance thereof (564.5).

Similar to other real property interests, an easement must be signed and acknowledged by the grantor. The deed will not be deemed lawfully recorded until it has been previously acknowledged or proved in the manner prescribed by Iowa Statutes, chapter 9b. The acknowledgment of an easement deed, whether made within the state of Iowa, outside the state, outside the United States, or under federal authority, should comply with the provisions of chapter 9b of the Iowa Statutes. Notary acts in Iowa can be performed by any of the following: a notary public of the state; a judge, clerk, or deputy clerk of the state; a person authorized by Iowa law to administer oaths; any other individual authorized to perform the specific act by the law of Iowa; or a registrar of vital statistics or a designee of a registrar of vital statistics (9B.10). Notarial acts must be evidenced by a certificate, which must meet the requirements as listed in 9B.15 of the Iowa Statutes.

Unless an easement deed is filed and recorded in the county in which the real estate is located, it will not be valid against subsequent purchasers for a valuable consideration, without notice, or against the state or any of its political subdivisions during and after condemnation proceedings against the real estate. An interest in real estate evidenced by a filed instrument will have priority over any lien that is given equal precedence with ordinary taxes, except for the provisions listed in 558.41 of the Iowa Statutes.

Pros, quick purchase and document availability including instructions and examples. Cons, For the cert. of trust, the form would not accept the length of our trust name with no way to get around. The pdf file printing did not meet the requirements for 2.5" top margin and .5" other margins as well as the 10pt font size as the form information was shrunk down even when normal printing.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

I needed a quitclaim deed to transfer ownership of a home. An attorney wanted $400.00 to file the deed. I downloaded a blank deed for my area from deeds.com. I received it instantly. (Small fee) it came with instructions and a template. I filled it out and submitted it to the County Clerks office.it was simple and I saved a lot of money. There may be other forms you need, check with whoever you are submitting the deed. You'll have additional fees, but that is up to the municipality in which you reside. It will be helpful if you have the latest deed on file. It was much easier than I thought. This is an easy website to navigate through and it is 100% legitimate. I recommend Deeds.com.
