Under Iowa Code 558.46, if the contract is not recorded within 90 days of execution, the seller may be subject to fines and penalties, and the buyer may take steps to record the contract or memorandum to protect their interest.
Information Typically Included in a Memorandum of Contract: (If a real estate contract is required to be recorded under this section, the requirement is satisfied by recording either the entire real estate contract or a memorandum of the contract containing at least the names and addresses of all parties named in the contract, a description of all real property and interests in the real property subject to the contract, the length of the contract, and a statement as to whether the seller is entitled to the remedy of forfeiture and as to the dates upon which payments are due. Example deed given did not apply to married couples as joint owners with both being grantors. The example and directions also did not show how to write more than one grantee as equal grantees. Both would have been helpful when husband and wife are granting their property to their children equally. Also when attaching the exhibit A with the property description the example did not say "see exhibit A"in the property description area, so I didn't write that. Luckily the recorder of deeds allowed me to write it in. I think directions and examples for multiple scenarios would be helpful.

I didn't care for it because I was having to do other things in between filling it out and all of a sudden it would not allow me back in it to make changes. Luckily I had saved it and then had to do FILL/SIGN option which looks ugly but that was the only way I could add what I needed.
