In Kansas, a Limited Power of Attorney (LPOA) for the sale of real estate is a legal document that grants a designated person (the agent or attorney-in-fact) the authority to handle specific matters related to the sale of real property on behalf of the principal (the person granting the power). This power can include signing documents, handling transactions, and making decisions related to the sale. However, the statutes and legal requirements can be complex and are subject to change, so it's important to consult a legal professional for the most current and applicable advice.
General guidelines regarding a Limited Power of Attorney for real estate in Kansas:
Written Document: The power of attorney must be in writing. It should clearly state the principal's name, the agent's name, and the specific powers granted.
Durability: This document shall continue in effect during any subsequent disability, incompetency, or incapacity of the principal in accordance with the provisions of K.S.A. 58-650, et al.,
Acknowledgment: The document typically needs to be signed by the principal and should be notarized. This is particularly important for real estate transactions, as a notarized document is usually required for recording the deed or other documents in county records.
Specificity: Since it is a limited power of attorney, the document should specify exactly what real estate is involved and what powers the agent has regarding the sale of that property. This can include the power to negotiate and accept offers, execute documents, and handle closing procedures.
Recording: In many cases, the power of attorney document must be recorded with the county recorder’s office in the county where the property is located, especially if it will be used for executing deeds or other documents that will be recorded.
Effective and Termination: It is intended that this power of attorney is to become effective immediately upon execution and terminates upon the completion of the sale of the property.
Legal Capacity: The principal must be of sound mind and have the legal capacity to execute the power of attorney at the time it is signed.
Compliance with Other Laws: Ensure that the document complies with other relevant Kansas laws and any specific requirements of the county where the property is located.

Using Deeds.com was unbelievably quick and easy to file a deed restriction with our local county office. From uploading the initial file to deeds.com, to having a fully recorded document was right on one hour - and all from the comfort of my home. I found your service was easy to use and your staff were very quick in responding to my filing. I will definitely use and recommend deeds.com in the future.
Thank you for your feedback. We really appreciate it. Have a great day!

This was the easiest, quickest, most understandable way I've seen yet to retrieve deeds from various counties. The government websites are "clunky" and each one seems different than the other. I like this service and will use them again in the future. NANCY

My county accessors office recommended this site. My Uncle passed away and did not leave a will and I needed to have his deed transferred into my name. I was able to do it using the sample Deeds.com provided. I used it as a guide to fill out the paperwork that I printed off of the Deeds.com site. I had no problem when I went to the county and turned in the paperwork and the clerk said everything looked great.
Thank you so much for taking the time to share your experience Lori. We are deeply sorry for your loss and understand how challenging managing affairs can be during such a difficult time. It's heartening to hear that our resources were helpful to you in transferring your uncle's deed into your name.
We strive to make complex processes more accessible and manageable, and your feedback affirms the value of our work. Knowing that the county assessor's office recommended us and that the clerk found everything in order with your paperwork is incredibly gratifying.

The fill-in pdf produced a messy document and several of the fields too small to accommodate the text. A tailorable MS Word document would have been far better. I would not recommend using this product.
Thank you for taking the time to share your feedback. We’re sorry to hear that the fill-in PDF did not meet your expectations, particularly with regard to formatting and field sizing.
Based on your comments, we will be reviewing the document to see where improvements can be made. Feedback like yours is genuinely helpful in identifying areas where our forms can be clearer and easier to use.
We’ve gone ahead and canceled your order and refunded your payment in full, so there’s no expectation that you use a product you wouldn’t feel comfortable recommending.

I love deeds.com - hands down, the quickest way to record a warranty deed. The process and communication is so quick - the recording transaction too. Worth the extra $20 to me for my time! I didn't spend over an hour driving around, talking to someone via a kiosk to record the deed, didn't have to spend the energy of loading kids into the car to come with me, etc. The efficiency and timely process is worth the cost! Love having this available! The whole process via deeds.com took less than 5 minutes to upload a document and less than 3 minutes to pay the invoice shortly thereafter. The final recording was in my inbox in less than an hour. Thank you!
Thank you for your feedback. We really appreciate it. Have a great day!
