Using a Kansas Affidavit of Death to Complete a Transfer on Death
In Kansas, the county assessor's office initiates the transfer of real property rights under a transfer on death deed. There are several steps to take, however, before that can happen.
When the property owner dies, an individual with personal knowledge of the intended transfer, whether the named beneficiary or someone else, makes the sworn statements contained within an affidavit of death. The affidavit, along with an official copy of the deceased owner's death certificate, is filed for record with the register of deeds for the county where the land is located.
The register of deeds then forwards the details to the county assessor's office, where they match the information on the affidavit with the deed records. After the assessor's office verifies the details, they begin the process to transfer the previous owner's rights to the beneficiary.

The instructions and example for filling out the form were very clear and detailed making the whole process fairly easy. An attorney I talked to wanted $200 to fill out this simple form. Order Process: 5 Stars - very easy Material Received: 2 Stars Issues: 1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office. 2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font. 3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility. Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability. regards, Jim S
