Gifts of Real Property in Mississippi
A gift deed, or deed of gift, is a legal document voluntarily transferring title to real property from one party (the grantor or donor) to another (the grantee or donee). A gift deed typically transfers real property between family or close friends. Gift deeds are also used to donate to a non-profit organization or charity. The deed serves as proof that the transfer is indeed a gift and without consideration (any conditions or form of compensation).
Valid deeds must meet the following requirements: The grantor must intend to make a present gift of the property, the grantor must deliver the property to the grantee, and the grantee must accept the gift. Gift deeds must contain language that explicitly states no consideration is expected or required, because any ambiguity or reference to consideration can make the deed contestable in court. A promise to transfer ownership in the future is not a gift, and any deed that does not immediately transfer the interest in the property, or meet any of the aforementioned requirements, can be revoked [1].
A lawful gift deed must also include the grantor's full name and marital status, as well as the grantee's full name, marital status, mailing address, telephone number and vesting. Vesting describes how the grantee holds title to the property. For Mississippi residential property, the primary methods for holding title are tenancy in common, joint tenancy, and tenancy by entirety. A grant of ownership of real estate to two or more persons is presumed to create a tenancy in common, unless otherwise stated in the conveyance (Miss. Code Ann 89-1-7).
As with any conveyance of real estate, a gift deed requires a complete legal description of the parcel. Recite the source of title to establish a clear chain of title, and detail any restrictions associated with the property. All deeds in the State of Mississippi also require the preparer to include indexing instructions. The indexing instruction is comprised of the section, township, and range, and one or more quarter sections or governmental lots or other applicable subdivisions of each section in which the land subject to the conveyance is located (Miss. Code Ann. 89-5-33(3)). Include all relevant documents, affidavits, forms, and fees with the along with the deed for recording. Record the completed deed at the local County Recorder's office.
The IRS levies a Federal Gift Tax on any transfer of property from one individual to another with no consideration, or consideration that is less than the full market value. Gifts of real property in Mississippi are subject to this federal gift tax. In accordance with federal law, individuals are permitted an annual exclusion of $15,000 on gifts. This means that gifts valued below $15,000 do not require a federal gift tax return (Form 709). Even so, grantors should consider filing one for many gifts of real property [2]. The grantor is responsible for paying the federal gift tax; however, if the grantor does not pay the gift tax, the grantee will be held liable [1].
In Mississippi, there is no state gift tax. For questions regarding state taxation laws, consult a tax specialist.
With gifts of real property, the recipient of the gift (grantee) is not required to declare the amount of the gift as income, but if the property accrues income after the transaction, the recipient is responsible for paying the requisite state and federal income taxes [3].

A good service that saves a lot of time and precludes making a trip to the County Assessors Office. Valuable service.
Thank you!

My county accessors office recommended this site. My Uncle passed away and did not leave a will and I needed to have his deed transferred into my name. I was able to do it using the sample Deeds.com provided. I used it as a guide to fill out the paperwork that I printed off of the Deeds.com site. I had no problem when I went to the county and turned in the paperwork and the clerk said everything looked great.
Thank you so much for taking the time to share your experience Lori. We are deeply sorry for your loss and understand how challenging managing affairs can be during such a difficult time. It's heartening to hear that our resources were helpful to you in transferring your uncle's deed into your name.
We strive to make complex processes more accessible and manageable, and your feedback affirms the value of our work. Knowing that the county assessor's office recommended us and that the clerk found everything in order with your paperwork is incredibly gratifying.

Really good product, included guide to filling out forms. Totally pleased with that part. Customer service however was terrible. Did not hear back after I sent two emails. The site signed me up but after I was accepted they would not allow me to download a form, with the notation my account was closed. Had to use another email. Had problems with that. Finally got off of site and went to a login site that allowed me to download the forms. If you can get past setting up your account, it is fantastic site. Nice price compared to alternatives. Also I recieved two validation codes. Have no idea why they were sent.
Thank you!

Thank you! My husband and I went in the get notary stamps for a Special Warranty Deed and a Post Nuptial Agreement. The representative was very knowledgeable and thorough with the notary process. She made sure we read and understood all documents that we were signing and they required us to recite in sworn statements that everything there was true and understood! I will be using the notary service again at Bank of America! The representative was very respectful and had a nice smile the entire time to make our visit great!
Thank you!

Your Personal Representative's Deed and example for the state of PA were extremely helpful. Exactly what I needed! Two feedback comments: 1. Valuation Factors/Short List in my download is an outdated table dated July 2020. The PA Dept of Revenue website has a more current table dated June 2021. (Maybe same for Valuation Factors/Long List, which I didn't use.) 2. Notarization section on deed page 3 has a gender-related input needed, which confused the Notary Public representative where I live in the state of CO. Notary input the word she to apply to my wife, but wasn't clear to him if the gender input applied to the Grantor or the Notary. He assumed Grantor. Also in our non-binary world, some might find that wording offensive. Thanks again for your documents. Russ Lewis

why not word format??
Good question. There are many reasons, we'll touch on a few. For the end user (you) Adobe Reader is free, Word is not. PDF is the portable document standard, Word is a decent word processor. A portable document format (PDF) maintains document formatting such as margins and font size which is very important to legal documents, Word does not. Have a wonderful day.

Guidelines somewhat helpful. Forms fillable but not editable unless you buy an Adobe conversion service subscription. End product looks crude and amateurish. Fields can't be reduced or enlarged to accommodate unique data. Very disappointing.
Thank you for your feedback. We really appreciate it. Have a great day!
