Record the affidavit under the Nebraska Probate 30-24,129 to transfer a decedent's real property without probate when certain criteria are met. The affidavit must be recorded in each county in which the real property described within the affidavit is located, along with a certified copy of the decedent's death certificate.
The affiant, or person executing the affidavit, is the successor in interest to the decedent's real property described in the affidavit, or an agent legally acting on the successor's behalf.
Statutory requirements stipulate that the affidavit state that total value of the decedent's real estate interests is $50,000.00 or less; thirty (30) days have passed since the decedent's death, as evidenced by a certified copy of the death certificate; there is no personal representative or pending petition for appointment of a personal representative; the successor is entitled to receive the property through a homestead, exempt property, or family allowance, or by devise or intestate succession; the successor has made an investigation and was unable to determine a subsequent will; and no other person has a right to the interest of the subject property. In addition, the successor's relationship to the decedent, the total value of the decedent's estate, and a complete legal description of the subject parcel is required. Each successor in interest to the subject property must sign the affidavit in the presence of a notary public.

These products would be more useful if they final deed could be copied and pasted into a word document for proper formatting. Because most of the document is protected against selecting and copying, I did not find it useful. I would not purchase again.

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. I am a litigator based in Lee County that rarely needs to record deeds or mortgages. However, at times, the settlement or resolution of a dispute results in the conveyance of real property. I ended up in a situation where a deed to real property in Bradford County needed to be recorded on behalf of a client. My usual e-recording vendor does not include that County. Registering with Bradford County's regular e-recording vendor would have required an expensive and unnecessary annual fee. Deeds.com was easy to use, inexpensive and fast. I highly encourage its use, especially for lawyers that occasionally need to record instruments but do not do so regularly.
