A Deed of Trust assignment, also referred to as an "Assignment of Deed of Trust", occurs when the beneficiary/lender of the loan transfers their loan obligations to a third party. The lender usually assigns a Deed of Trust by selling it to a new bank or lender. This form can be used by the current beneficiary/lender even if the Deed of Trust in question states a different beneficiary/lender.
Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Deed of Trust" forms.
The Truth and lending act requires that borrowers be notified when their Deed of Trust has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

Not knowing I could down load these forms, I first went to the local recording office thinking I could get info on the forms I needed. I was told that obviously you dont know what you are doing so find someone who does. This snippy clerk obviously didnt know the forms were accessible on line; either that or she was needing to feel her phony superiority.

Very easy to use and no hidden costs. You get to download whatever you need and can save it and even reuse it. So it's like having your own library of form that you pay for once. They even give you more related forms than you ask for and it turned out we needed some if those forms as well. The forms meet what our county requires for margins in records and so on. What you are seeing is one payment and a hold placed by your financial institution for the declined attempt. We are not sure why they do this but the hold usually falls off after a few day depending on their policy.
