A New Mexico warranty deed configured for two grantors carries two signature blocks and two acknowledgment certificates, one for each owner giving up an interest in the property. This fillable form prepares that deed for two record owners who join in one conveyance, carrying the operative words of the statutory form at NMSA 1978, Section 47-1-44 and the full covenants those words import.
Two grantors, two signatures, two certificates
The form's first section recites both grantors, each with a marital status line, then collects the grantee with a mailing address and any co-ownership designation, the county and formal legal description, the street address, the source of title, and the matters the conveyance is subject to. Both grantors sign, and each signature takes its own acknowledgment certificate, so the two owners may acknowledge on different dates, in different counties, or before different notarial officers. Spouses conveying community real property, and two co-owners of record, such as siblings holding inherited land as tenants in common or joint tenants selling together, present the two-grantor pattern this deed recites. The form recites exactly two grantors; a conveyance by a sole owner, and a conveyance by three or more owners, follow different execution patterns.
The community property rule behind the second signature
In New Mexico, the second signature is often the one the law watches. Property acquired during marriage is presumed community property, and NMSA 1978, Section 40-3-13 provides that both spouses join in every transfer, conveyance, mortgage, or lease of community real property; an attempt by one spouse alone is void and of no effect, and New Mexico case law lets anyone invoke that voidness, not only the nonjoining spouse. The rule even reaches separate real property that spouses own together as joint tenants or tenants in common, a trap most community property states do not carry. A married couple completing this deed as its two grantors places both statutorily required signatures on one instrument.
Full warranty covenants in two statutory words
The operative section grants the described real estate with warranty covenants, and NMSA 1978, Section 47-1-37 gives those two words their content: covenants that the grantors are lawfully seized in fee simple, that the property is free from encumbrances beyond those the deed recites, that the grantors have good right to sell and convey, and that the grantors and their successors will stand behind the title against the lawful claims of all persons, wherever in the chain of title a defect arose. Each grantor conveys that grantor's entire interest, and the deed's exceptions entry defines what the covenants do not reach, such as recorded easements, subdivision restrictions, and the current year's taxes.
Recording in the county where the land lies
New Mexico recording runs through the county clerk on a statewide flat fee: twenty-five dollars per document, identical in every county, with another twenty-five dollars only when a document pushes past ten index entries, and every indexed name and separate legal description unit counts as an entry. Acknowledgment is the gate; a deed that is not duly acknowledged may not be recorded at all. The first page of this form leaves the top blank for the clerk's recording label, and the layout sits above the strictest published county format figures, so one document travels statewide. After recording, most residential transfers call for a confidential transfer declaration affidavit filed with the county assessor within thirty days, a separate filing the guide walks through step by step, prepared apart from the deed and not included in this package.
