In this form the assignment/transfer of a Trust Deed/Deed of Trust is made by the beneficiary/lender or successor in interest.

("Trust deed" means a deed executed in conformity with ORS 86.705 (Definitions for ORS 86.705 to 86.815) to 86.815 (Time within which foreclosure must be commenced) that conveys an interest in real property to a trustee in trust to secure the performance of an obligation the grantor or other person named in the deed owes to a beneficiary.) (ORS 86.705(8))

("Beneficiary" means a person named or otherwise designated in a trust deed as the person for whose benefit a trust deed is given, or the person's successor in interest, and who is not the trustee unless the beneficiary is qualified to be a trustee under ORS 86.713 (Qualifications of trustee) (1)(b)(D).) (ORS 86.705(2))

ORS 86.060 Assignment of mortgage Mortgages may be assigned by an instrument in writing, executed and acknowledged with the same formality as required in deeds and mortgages of real property, and recorded in the records of mortgages of the county where the land is situated.

ORS 86.715 Trust deed deemed to be mortgage on real property A trust deed is deemed to be a mortgage on real property and is subject to all laws relating to mortgages on real property except to the extent that such laws are inconsistent with the provisions of ORS 86.705 (Definitions for ORS 86.705 to 86.815) to 86.815 (Time within which foreclosure must be commenced), in which event the provisions of ORS 86.705 (Definitions for ORS 86.705 to 86.815) to 86.815 (Time within which foreclosure must be commenced) shall control. For the purpose of applying the mortgage laws, the grantor in a trust deed is deemed the mortgagor and the beneficiary is deemed the mortgagee.

Included are "Notice of Assignment of Trust Deed" forms. The current Mortgagor/Borrower/Grantor must be notified of the assignment, generally within 30 days to avoid penalty.

The recording of the assignment of a mortgage is not of itself notice of such assignment to the mortgagor, or the heirs or personal representatives of the mortgagor, so as to invalidate a payment made by any of them to the mortgagee.

I tried to use the free stuff you find on the internet. You quickly find out that free is rarely ever (never) free. Even worse, the long term cost can be immeasurable. Glad I realized that before I got too far in. Do yourself a favor, spend a few bucks up front to get the right forms.

I purchased the Notice of Completion form because the City of Chula Vista did not have a "fillable" version of this form on their website. The Deeds.com version of this form is somewhat different than the City's version (8 numbered paragraphs vs. 11 numbered paragraphs.) However, it contains the same information in a different format. This form provided more blank space to fill in important items- like a long ownership name- than the version on the City's website. The recorder's office was satisfied with this form as I hand-delivered it to the Recorder's Office and they approved it for recording. Overall, I found this form easy to use and found the extra blank space for writing on the form helpful. My one comment for possible improvement is: it would be even more helpful (particularly for attorney users) to have strike-out capability. I would have liked having the ability to strike-out inapplicable portions of long awkward sentences. Still, I would use this form again.

This service is excellent. I submitted a Quickclaim Deed so my home would be in the name of a Living Trust I had just created. This was my first attempted at any of this and the staff person, KVH, who reviewed my Deed was extremely helpful and quick to respond to any questions I had and to make sure the Deed had the correct information before submittal to the county for recording. I started the process one afternoon and by the next day, the Deed was submitted to, and recorded in, my county. I will use them again whenever needed.

PDF fields change font sizes leading to an unprofessional-appearing printed page. The examples for "Convey to" section don't include how to specify just one person instead of a married couple. Maybe that is simple but it would help to spell it out in an example. Haven't submitted to County Recorder yet, so will find out if it is acceptable.

The font issue is caused by using a PDF viewer other than Adobe Acrobat Reader. Our form fields are set to a uniform 12-point font, but non-Adobe viewers often render form fields inconsistently. Opening and printing the form with the free Adobe Acrobat Reader will resolve that.

Regarding the examples, that's a fair point, we'll look at expanding them.
