Mechanic's Lien assignments can be accomplished by filing an assignment of lien document with the county recorder or prothonotary office where the subject property is located and where the lien was originally recorded.

One of the fundamental principles of contract law is the right to assign contract rights to a third party. For example, Bill contracts with Ted to build a house for Ted. Bill then assigns the right to payment for the house to Fred (maybe he owes Fred some money on a debt). This is called an "assignment." With the basic legal terminology clarified, let's move on to how lien assignments work in Pennsylvania.

Typically, under the rule on assignments, all rights of either seller or buyer can be assigned except where the assignment would materially change the duty of the other party, or increase materially the burden or risk imposed on the other party by the contract, or impair materially the other party's chance of obtaining return performance. In general, as long as there is no increased burden or risk, or the duties required by the party subject to the lien somehow change, an assignment is permissible.

A valid assignment identifies the parties, the subject property, relevant dates, fees, and payments, and any other details needed for the specific situation. In addition, the document must meet all state and local standards for recorded documents.

Mechanic's Liens are governed by Title 49 of the Pennsylvania Consolidated Statutes.

I have one suggestion and couple of question I would think that most TOD's would be from married couples. It would be real helpful to have a example of the I(we) block for married couples. Why would I check or not check the "property is registered (torrents)" Do I need a notarized signature of the Grantee

I needed a Missouri Notice of Intent to Sell without a named designated buyer. Mo Statutes require notice be notarized and filed 45 days before any closing to protect buyer from liens. You do not have that document. We are flipping a house so it must be filed. Our lawyer was on vacation. Cannot find one anywhere on net. Finally got a template from our title company.

Ordered quitclaim deed form for Knox county Illinois. It got the job done however it was not a very good format. I had to explain all to the county recorder & was worried she would reject it. I would not recommend this item.

The forms are very confusing when there is so much to download! Trying to keep track and make sure you have everything needed is terrible! I think I have everything but I was under the impression I would be filling it out online and with instructions... I am very disappointed to say the least!

I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.
