This form is used by the current lender/beneficiary to Assign/transfer a Deed of Trust and Promissory Note to another party, this is usually done when a note has been sold.
Recording requirements include:

- Reference original Volume & Page of assigned document
- Maximum Principal Indebtedness for Tennessee Recording Tax Purposes is $0 (If amount is listed taxes must be paid)
Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Deed of Trust" forms.
The Truth and lending act requires that borrowers be notified when their Deed of Trust debt has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

Your documents were very helpful. I went ahead and filled in all the info for the Release of Lien document. It was easy to do with your example. I had all the necessary info such as plot numbers, etc. for the property and everything fit nicely onto the document. It has been notorized and mailed. The process for obtaining document itself was easy, and the included guide and example are great! I do have an issue with the format itself, though. The form has pre-defined text boxes, which cannot be altered without partially rebuilding the entire document. For the 'property description' field on the Mineral Deed form, the text box is not large enough for the rather lengthy legal description entered on my original plat. Fortunately, I have a copy of Adobe Pro, so I have been able to re-build the doc to accommodate this short-coming.

The Transfer on Death Deed form package was very good. But like anything, could use some improvements. There is not enough space to fill more than one beneficiary with any level of additional detail like "as his sole and separate property" The area for the legal description could be a bit bigger and potentially fit many legal descriptions. Or it could be made to simply say "See Exhibit A" as is likely necessary for most anyway. The guide should indicate what "homestead property" means so the user doesn't have to research the legal definition. (which turns out to be obvious, at least in my state, if you live there, it's your homestead.) It would be helpful if an "Affidavit of Death" form were included in the package for instances where the current deed hasn't been updated to reflect a widowed owner as the sole owner before recording with only the one signature.

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

This was a seamless process. It probably took one minute to fill out my information and upload the document. It was formatted and sent immediately. It was processed the next day at the county recorders office. I have zero complaints. Before finding this company I spent an entire day calling and leaving messages at other e-filing companies like simplfile and others but they all required subscriptions.
