A durable power of attorney designates in writing an agent (attorney in fact) and contains the words. (This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or This power of attorney shall become effective upon the disability or incapacity of the principal, or similar words showing the intent of the principal that the authority conferred shall be exercisable, notwithstanding the principal's subsequent disability or incapacity.) (34-6-102.)
This instrument offers three choices for effective dates.
1. Immediately
2. Upon incapacity
3. Immediately when my spouse is acting as my Agent. If my spouse declines, is unable or ceases to serve as Agent, this Power of Attorney becomes effective upon my becoming disabled or incapacitated.
In the event your agent is unable or unwilling to serve a (substitute Agent) is named.
When the principal is (disabled or incapacitated). All acts done by the agent (attorney in fact) (bind the principal and the principal's successor in interest as if the principal were competent and not disabled.) 34-6-103
In general, if the attorney if fact acts under the power of attorney, he/she has a duty to account to the principal, or any legal representative. 34-6-107
This Durable Power of Attorney states: Pursuant to T.C.A. 34-6-101 et seq. and T.C.A. 34-6-201 et seq. (collectively the "Law"). I intend for the Law to apply in all respect and for this instrument to be construed broadly and not narrowly.

This is another great deal that has come out of the quarantine for covid. Saved me hours and days of time. and provides a way to file deeds that really isn't done effectively anyway else. It was also very inexpensive that you would not expect. I didn't even have to leave home.

Forms easy to download but experienced problems trying to type in my information into the forms. Then when I went to print a form, Adobe wanted to charge me for printing. I ended up printing the blank forms and then filling them out manually.

I didn't care for it because I was having to do other things in between filling it out and all of a sudden it would not allow me back in it to make changes. Luckily I had saved it and then had to do FILL/SIGN option which looks ugly but that was the only way I could add what I needed.

This is an initial review of Deeds.Com and the ordering process for their Quit Claim package for Virginia. The ordering process was very easy and the price seems reasonable for what you get. I have reviewed and downloaded all my forms, but have not used them yet. Thus far I am pleased with the product and the process. Well, we are 10 days from leaving the country for months and needed to notarize and record deed changes to our rental properties. We worried about USPS, UPS, DHL, etc. and hardcopies in the County's bureaucrats' hands. Soooo, we learned of Deeds.com from the County web site via one of the bulk digital recorders telling me about Deeds.com. Hit their site, read their instructions, concluded my tiny brain and decrepit abilities could handle the chore. WITHIN AN HOUR OF UPLOADING EVERYTHING INCLUDING C.C. FOR PMT IT WAS RECORDED AND I printed out copies. WORTH the $$ in speed, convenience and PEACE of mind. Pardon the loud trumpeting.
