Using an Indemnity Agreement to Protect from Liens in Tennessee
Property owners can protect themselves from a mechanic's lien on their land by executing an indemnity agreement binding both the contractor and indemnity company. By entering into an agreement, the insurer agrees to pay the contractor any amount that could otherwise be enforced through a lien placed on the property. This way, the contractor will turn to the insurance agency and not the land owner for any deficiency that is owed.
This indemnity agreement is designed to be used by contractors and material providers as well as property owners. I am a litigator based in Lee County that rarely needs to record deeds or mortgages. However, at times, the settlement or resolution of a dispute results in the conveyance of real property. I ended up in a situation where a deed to real property in Bradford County needed to be recorded on behalf of a client. My usual e-recording vendor does not include that County. Registering with Bradford County's regular e-recording vendor would have required an expensive and unnecessary annual fee. Deeds.com was easy to use, inexpensive and fast. I highly encourage its use, especially for lawyers that occasionally need to record instruments but do not do so regularly.

This is a wonderful service and your staff is very responsive through the chat. My one suggestion is that there be an added sentence to your instructions that sates that once you upload there is nothing more to do as in a "submit" or "Finished uploading" button. After uploading instinct says there is something to click to let you all know that we have finished with our uploads.

I needed to create a deed of distribution for my probate case. The instructions as to what was needed on the caption page was lacking. Because of the lack of information I still had to have an attorney review the documents as I didn't feel confident in the instructions given.
