Using an Indemnity Agreement to Protect from Liens in Tennessee

Property owners can protect themselves from a mechanic's lien on their land by executing an indemnity agreement binding both the contractor and indemnity company. By entering into an agreement, the insurer agrees to pay the contractor any amount that could otherwise be enforced through a lien placed on the property. This way, the contractor will turn to the insurance agency and not the land owner for any deficiency that is owed.

This indemnity agreement is designed to be used by contractors and material providers as well as property owners. Although this form is designed for ease of use, it may not be appropriate in every circumstance. It is always a good idea to consult with an attorney when drafting a contract between two parties.

The process was fast and efficient. I did get a bit confused after entering info for my package but soon realized I had completed this part of the process and only needed to leave the page and wait for review of the document and then the invoice. It was pretty simple. After payment of the invoice I was notified that the document had been submitted. A few hours later I received notice that the document was recorded by the city. It was fast!

The guide I needed was very easy to understand and the template was easy to complete. I had a property attorney review the deed before I had it registered and she was impressed. Ordered the forms, completed them, had them notarized, then erecorded all in under 2 hours. Would have been faster but had to wait for the bank to open for notary. Might try the online notary next time. Fantastic experience.

The process was easy going. The process is one thing, the results another. I have attempting to resolve this matter, of claiming sole ownership of the property for several YEARS. I lost my Bride of 65 years in 2015. A lawyer I hired failed in his attempt, so I'm waiting to see the actual results.
