An enhanced life estate deed—commonly called a Lady Bird deed—allows property owners to name a beneficiary who will receive real estate at the owner's death, without the property passing through probate. The owner retains a life estate with full control during their lifetime, including the power to sell, mortgage, or convey the property without the beneficiary's consent.
How It Works
The grantor conveys a life estate to themselves while designating a remainder beneficiary. Unlike a traditional life estate deed, the "enhanced" version includes a reserved power of appointment, meaning the owner can change the beneficiary, revoke the deed entirely, or transfer the property at any time—no permission from the beneficiary required.
Key Features
The deed is designed to preserve homestead status (if claimed) along with associated property tax exemptions and protections during the owner's lifetime. Because the transfer does not take effect until death and the owner retains full control, no gift occurs for federal gift tax purposes at the time of recording.
Lady Bird Deed vs. Transfer on Death Deed
Texas recognizes both Lady Bird deeds and statutory transfer on death deeds (TODDs). Both accomplish similar goals, but they operate differently. A TODD is governed by statute (Texas Estates Code Chapter 114) and follows specific execution and recording requirements. A Lady Bird deed is a common-law instrument with a longer history of use. The right choice depends on the owner's circumstances; for complex situations, consult a local attorney.

Really good product, included guide to filling out forms. Totally pleased with that part. Customer service however was terrible. Did not hear back after I sent two emails. The site signed me up but after I was accepted they would not allow me to download a form, with the notation my account was closed. Had to use another email. Had problems with that. Finally got off of site and went to a login site that allowed me to download the forms. If you can get past setting up your account, it is fantastic site. Nice price compared to alternatives. Also I recieved two validation codes. Have no idea why they were sent.

Working with one document at a time every thing was great, but the program will not let multiple documents save independently. When I saved a document and created another document the changes I made on the second document were on the 1st document. No big deal if your printing, but if your saving to email later, its an issue.

PDF fields change font sizes leading to an unprofessional-appearing printed page. The examples for "Convey to" section don't include how to specify just one person instead of a married couple. Maybe that is simple but it would help to spell it out in an example. Haven't submitted to County Recorder yet, so will find out if it is acceptable.

The font issue is caused by using a PDF viewer other than Adobe Acrobat Reader. Our form fields are set to a uniform 12-point font, but non-Adobe viewers often render form fields inconsistently. Opening and printing the form with the free Adobe Acrobat Reader will resolve that.
Regarding the examples, that's a fair point, we'll look at expanding them.
