A bargain and sale deed is a conveyance of property rights wherein the grantor (owner) guarantees to the grantee (buyer) that during the time the grantor owned the real estate, he/she did nothing to cloud the title to the property.
In Washington, statutory bargain and sale deeds are governed by RCW 64.04.040. The statute defines the covenant to the grantee this way: "the grantor was seized of an indefeasible estate in fee simple, free from encumbrances, done or suffered from the grantor, except the rents and services that may be reserved, and also for quiet enjoyment against the grantor, his heirs and assigns, unless limited by express words contained in such deed; and the grantee, his heirs, executors, administrators and assigns may recover in any action for breaches as if such covenants were expressly inserted."
As with other deeds in Washington, record an executed bargain and sale deed at the recorder's office located in the same county as the land. Recording is the essential final step in land sales -- presenting the deed for entry into the public record keeps the property's chain of title updated and provides notice to any potential buyers about the change in ownership.

Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!

The deed is great. However, I do not believe your Statement of Full Consideration is up to date as it does not give the reference for an exemption on the Transfer on Death Deed.

This is not at all the form that I needed. I am trying to disclaim my interest in a property, but this form is much too rigid to work for my case. It would have been nice to know some of the more specific details before purchasing the document.

I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.
