Revoking a Transfer on Death Deed in Washington
Earlier this year, the Washington legislature voted to join with an increasing number of states and adopt the Uniform Real Property Transfer on Death Act (URPTODA). The law is found at Chapter 64 of the Revised Code of Washington, and went into effect on June 12, 2014. This act allows owners of real property in the state to control the distribution of what is often their most significant asset, their real estate, by executing and recording a transfer on death deed (TODD).
Revocation is an important feature of transfer on death deeds because it allows the owner/transferor to easily respond to a change in circumstances. This option explains why TODDs do not require consideration or notice (64.80.070). At 64.80.080, the statute outlines the three methods available for changing or revoking a recorded transfer on death deed, by executing and recording:
- a new TODD
- a revocation form
- a deed (example: warranty deed) that conveys title to someone else and expressly revokes all or part of the TODD
To preserve a clear chain of title, it makes sense to file a revocation form when changing a previously recorded transfer on death deed or selling the property outright. This extra step will add an end point for the potential transfer, simplifying future title searches prior to selling or mortgaging the property.

The form was useful, however the formatting is terrible once completed. A lot of white space with no option to remove extra spacing or to improve the overall formatting.

They must have busy when I applied. The screen said it should be done in under10 mins unless heavier traffic. I was a little nervous because of a time deadline. It was completed in 45 mins and for under $30 it was worth every penny to have my deed details at my fingertips. So I give it a 5 on ease of use and quick handling. You can get it done less expensively, but great in a time crunch.

I purchased a Warranty Deed "package" on Friday and found that the Main download was a working document, but the secondary document (which is required) was not. In other words, I was able to use the fill-in feature on the main document, but not on the second document. I used the portal on the website to report my issue the same day. That was Friday. This is Wednesday. I have not heard a word from them and I have to use my documents in 2 days. I will probably have to resort to pen and ink for that document, but I have already tried filling it out twice and have to keep reprinting and starting over. You can't white out or cross out. I would really prefer to have the complete service that I paid for.
